THE COMMISSION OF THE EUROPEAN new representative rates, fixed by Council Regulation COMMUNITIES, (EEC) No 878/77 of 26 April 1977 on the exchange rates to be applied in agriculture (9), as last amended by Regulation ( EEC) No 2139 /79 ( l0) and referred to Having regard to the Treaty establishing the European in Article 2a^ apply in the pigmeat sector ; Economic Community,

Whereas the monetary compensatory amounts intro­ duced by Regulation ( EEC) No 974/71 were fixed by Commission Regulation ( EEC) No 2140 / 79 of 28 HAS ADOPTED THIS REGULATION : September 1 979 (4 ), as last amended by Regulation ( EEC) No 2250 / 79 (*) ;

Article 1 Whereas Council Regulation ( EEC) No 1641 / 79 of 24 July 1979 fixing the basic price and the standard In Annex I to Regulation (EEC) No 2140/79, Part 2 is quality for slaughtered pigs for the period 1 replaced by Annex I to this Regulation . November 1979 to 31 October 1 980 ( 6) fixed a new basic price ; whereas, in consequence , the lower limit of the buying in price applicable in the event of inter­ Article 2 vention in the pigmeat sector and determined in accor­ dance with the provisions of Article 5 ( 1 ) of Council Regulation ( EEC) No 2759/75 of 29 October 1975 on Annex II to Regulation ( EEC) No 2140/79 is replaced the common organization of the market in by Annex II to this Regulation . pigmeat ( 7), as last amended by Regulation ( EEC) No 1423/78 ( 8), is affected by it ; Article 3

Whereas it follows from this that the basis for deter­ mining the monetary compensatory amounts referred Annex IV to Regulation ( EEC) No 2140 /79 is deleted . to in Article 2 ( 1 ) of Regulation ( EEC) No 974/71 has changed ; whereas it is necessary, moreover, to take into consideration here that, as of 1 November 1979 , Article 4

(*) L'octroi des montants compensatoires monétaires applicables pour ces produits est subordonné au respect des conditions pour l'octroi des restitutions visées au règlement (CEE) n° 171/78. Au moment de l'accomplissement des formalités douanières d'exportation ou d'importation dans l'État membre qui paie le montant compensa­ toire monétaire, l'exportateur ou l'importateur concerné déclare par écrit que les produits en cause répondent à ces conditions . C) The grant of monetary compensatory amounts in respect of these products is subject to compliance with the conditions for the grant of refunds laid down in Regulation (EEC) No 171 /78. The exporter or importer at the time of the conclusion of customs formalities concerning the export or the import in a Member State paying the monetary compensatory amount, shall declare in writing that the products in question fulfil these conditions. (*) Voraussetzung für die Gewährung der 'Währungsausgleichsbeträge für diese Erzeugnisse ist die Erfüllung der in der Verordnung (EWG) Nr. 171/78 aufgeführten Bedingungen für die Gewährung der Erstattungen. Der Ein- oder Ausführer erklärt schriftlich zum Zeitpunkt der Erfüllung der Ausfuhr- oder Einfuhrzollförmlich­ keiten in dem Mitgliedstaat, der den Währungsausgleichsbetrag zahlt, daß die fraglichen Erzeugnisse diesen Bedingungen entsprechen.
