determining the amounts of the variable components, accession compensatory amounts and additional duties applicable from 1 August to 31 October 1981 on the importation into the Community of goods covered by Regulation (EEC) No 3033/80
THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Economic Community,
Having regard to the Act of Accession of Greece, and in particular Article 43 thereof,
Having regard to Council Regulation (EEC) No 3033 /80 of 11 November 1980 laying down the trade arrangements applicable to certain goods resulting from the processing of agricultural products ( 1), and in particular Articles 6 and 8 thereof,
Having regard to Council Regulation (EEC) No 3448 /80 of 22 December 1980 on the implementation of Article 43 of the Act of Accession of Greece concerning the system of trade applicable to the goods covered by Regulation (EEC) No 3033 /80 and (EEC) No 3035 /80 ( 2),
Whereas, pursuant to the first indent of Article 43 ( 1 ) of the Act, any accession compensatory amounts applicable when goods covered by Regulation (EEC) No 3033 /80 are imported from Greece into the Community are to be determined on the basis of the compensatory amounts referred to in Article 61 of the said Act and in accordance with the rules laid down in that Regulation for the calculation of the variable component applicable to the goods in question;
Whereas, under the second indent of the said Article 43 ( 1 ) of the Act, when such goods are imported into Greece from third countries the variable amount is to be reduced or increased by the accession compensatory amount applicable on importation of the same goods from Greece into the Community of Nine;
Whereas the rules for calculating the variable component applicable to each of the goods covered by Regulation ( EEC) No 3033 /80 are laid down in Article 6 ( 1 ) and (2) of that Regulation;
Whereas Council Regulation (EEC) No 3034/80 of 11 November 1980 (3) fixes the quantities of the basic products considered as having been used in the manufacture of goods covered by Regulation (EEC) No 3033 /80 ;

Whereas the threshold prices and the accession compensatory amounts applicable for cereals and rice during the marketing year 1981 /82 had not been fixed by the Council on 10 July 1981 ;
Whereas according to Article 7 ( 1) of Regulation ( EEC) No 3033 /80, if one of the factors to be used for calculating the variable component has not been determined by the tenth of the month preceding the quarter for which this variable component must be fixed, the Commission shall calculate the variable component on the basis of the factor used for calculating the variable component for the current quarter instead of the factor which is not available; whereas the same provisions apply mutatis mutandis to the accession compensatory amounts;
Whereas according to the abovementioned provisions and without prejudice to the possible fixation according to the provisions of Article 7 (2) of Regulation (EEC) No 3033 /80 of adjusted variable components and accession compensatory amounts the average accession compensatory amounts to be taken into account during August, September and October 1981 are as follows :

Whereas the first subparagraph of Article 6 (3 ) of Regulation ( EEC) No 3033 /80 provides that where, pursuant to the Regulations on the common organization of markets, a production refund or an aid is applicable in all Member States to basic products or to products assimilated thereto under Article 3 of the Regulation, the amount of the variable component shall be calculated by reference to the price resulting from the application of those measures instead of by reference to the average threshold price; whereas Article 3 of Regulation ( EEC) No 3034/80 specifies the goods to which these provisions are applicable;
Whereas the first subparagraph of Article 1 ( 1 ) of Council Regulation ( EEC) No 2742 /75 of 29 October 1975 on production refunds in the cereals and rice sectors (*), as last amended by Regulation ( EEC) No 1956/81 (2), provides that Member States shall grant a production refund on maize for the manufacture of starch of 1-723 ECU per 100 kilograms ;
Whereas, pursuant to Article 1 of Council Regulation ( EEC) No 1400/78 of 20 June 1978 laying down general rules for the production refund on sugar used in the chemical industry (3), a production refund shall be granted for white sugar used in the manufacture of certain chemicals ; whereas it is necessary to calculate the variable components on the basis of the prices resulting from the granting of these production refunds ;
Whereas, as regards the basic products specified in Article 2 of Regulation ( EEC) No 3033 /80, the averages, as calculated for the period comprising the months of May and June and the first 10 days of July 1981 for cif prices ( excluding special cif prices) or, as the case may be, free-at-frontier prices, used in fixing the levies applicable to each such basic product, are as follows :

Whereas the Common Customs Tariff provides, in the case of certain goods covered by Regulation (EEC) No 3033 /80, for a maximum duty comprising an additional duty on their sugar content expressed in terms of sucrose (ads) or on their flour content ( adf); whereas the rules for calculating such additional duties are set out in Article 8 (2) and (3 ) of that Regulation ; whereas, pursuant to Article 8 (4) of that same Regulation, the Commission is to determine each quarter the amount of the additional duties and the price differences used in calculating those additional duties;
Whereas the average threshold prices for common wheat flour and for rye flour to be taken into consideration for the months of August, September and October 1981 are as follows:

Whereas, pursuant to Article 6 ( 1 ) (b) of Regulation ( EEC) No 3448 /80, the variable component of the maximum charge applicable on importation into Greece from third countries is to be equal to the additional duty mentioned in Article 8 (2) of Regulation ( EEC) No 3033 /80 less the accession compensatory amount relating to the quantity of sugar or flour to which this additional duty applies;
Whereas, for the months of August, September and October 1981 , the average accession compensatory amounts applicable to common wheat flour and rye flour on importation into the Community of Nine from Greece are as follows :

HAS ADOPTED THIS REGULATION :
Article1¶
From 1 August to 31 October 1981 and in respect of goods covered by Regulation (EEC) No 3033 /80
— the variable components applicable on importation into the Community of Nine, from third countries, shall be as specified in Annex I,

— the accession compensatory amounts applicable on importation into the Community of Nine from Greece shall be as specified in Annex II,
-— the variable components applicable on importation into Greece from third countries shall be as specified in Annex III.
Article2¶
1 . From 1 August to 31 October 1981 , the amount of the additional duties as referred to in Article 8 (2) of Regulation (EEC) No 3033 /80 on various kinds of sugar expressed as sucrose ( ads), or on flour (adf), applicable on importation:
( a) into the Community of Nine from third countries, shall be as specified in the table in Annex IV ;
(b) into Greece from third countries, shall be as specified in the table in Annex V.
2 . From 1 August to 31 October 1981 , the difference in prices for white sugar and for common wheat flour and rye flour, as referred to in Article 8 ( 2 ) (a) of Regulation ( EEC) No 3033 /80 to be taken into account on importation:
( a) into the Community of Nine from third countries, shall be as specified in Annex VI;
( b) into Greece from third countries, shall be as specified in Annex VII.
Article3¶
This Regulation shall enter into force on 1 August 1981 .
This Regulation shall be binding in its entirety and directly applicable in all Member States.
