THE COMMISSION OF THE EUROPEAN marketing year ; whereas this central rate, which has COMMUNITIES , led to a new method of calculating monetary compensatory amounts , must, from 1 August 1984 , be taken into account for the calculation of Having regard to the Treaty establishing the European Economic Community, compensatory amounts applicable to products of the cereals sector and of the eggs, poultry and albumins sectors and to certain goods which are obtained from Having regard to Council Regulation (EEC) No agricultural products and are not listed in Annex II to 974/71 of 12 May 1971 on certain measures of the Treaty ; conjunctural policy to be taken in agriculture following the temporary widening of the margins of fluctuation for the currencies of certain Member Whereas the 1984 / 85 marketing year for cereals starts on 1 August 1984 ; whereas, from that date, the States ('), as last amended by Regulation (EEC) No new cereal prices have to be used for calculating the 855 / 84 (2), and in particular Article 6 thereof, monetary compensatory amounts applicable to cereals and to certain products and goods which fall within Having regard to Council Regulation (EEC) No the milk and milk products sector or the eggs, poultry 1223 / 83 of 20 May 1983 on the exchange rates to be or albumins sectors or which come within the scope applied in agriculture (}), as last amended by Regu of Regulation (EEC) No 3033 / 80 (7); whereas it is lation (EEC) No 855 / 84, also necessary to take into account that for the BLEU, Denmark, France , Greece and Ireland with Having regard to Council Regulation (EEC) No effect from 1 August 1984 , new representative rates 855 / 84 of 31 March 1984 on the calculation and the fixed by Regulation (EEC) No 1223 / 83 will apply to dismantlement of the monetary compensatory cereals and poultry products ; amounts applying to certain agricultural products, and in particular Article 7 thereof, Whereas Article 7 ( 1 ) of Commission Regulation (EEC) No 1160 / 82 of 14 May 1982 providing for the advance fixing of monetary compensatory amounts (8) Having regard to Commission Regulation (EEC) No 1516/78 of 30 June 1978 on the obligatory specifies that monetary compensatory amounts fixed in advance shall be adjusted if a new representative adjustments to be made to monetary compensatory rate which was decided upon before the application amounts fixed in advance and repealing Regulation (EEC) No 651 /78 (4), and in particular Article 1 (2) for advance fixing was lodged, takes effect during the thereof, period of validity of the certificate ; whereas this situation arises in the pigmeat sector in Denmark, Greece and Italy and in all sectors in the Federal Whereas the monetary compensatory amounts Republic of Germany and the Netherlands ; introduced under Regulation (EEC) No 974 / 71 were fixed by Commission Regulation (EEC) No Whereas the monetary compensatory amounts in the 900 / 84 (5), as last amended by Regulation (EEC) No durum wheat sector have been calculated taking into 2193 / 84 (6); consideration the situation of monetary compensatory amounts for by-products applicable on 1 July 1984 ; Whereas, under Article 2b of Regulation (EEC) No whereas this situation was revised at the beginning of 974/71 , the central rate used under the common agri the 1984 / 85 marketing year ; whereas the effect of cultural policy has been subjected to a corrective this therefore is that the monetary compensatory factor of 1,033651 with effect from the 1984 / 85 amounts for products falling within subheadings 11.02 A I a), 19.03 A, 19.03 B I and 19.03 B II of the Common Customs Tariff are altered with effect from O OJ No L 106, 12. 5 . 1971 , p. 1 . HAS ADOPTED THIS REGULATION : Whereas, in the case of Germany and the Netherlands, account should be taken of the differing Article 1 representative rates fixed in the cereals and poul trymeat sectors when setting the monetary coefficient Regulation (EEC) No 900 / 84 is hereby amended as referred to in Article 5 of Regulation (EEC) No follows : 1372 / 81 ('), as last amended by Regulation (EEC) 1 . Parts 1 , 4 and 8 and subheading 23.07 B in Part 5 No 766 / 83 (2), in respect of the eggs, poultry and of Annex I are replaced by the parts given in albumins sectors ; Annex I hereto . 2 . Annex VI is repealed. Whereas , for the reasons given above, it is necessary to amend Regulation (EEC) No 900 / 84 with effect 3 . Annexes II and IV are replaced by Annexes II and from 1 August 1984 ; IV to this Regulation.

Article 2 Whereas the measures provided for in this Regulation are in accordance with the opinions of the relevant This Regulation shall enter into force on 1 August management committees, 1984 .

This Regulation shall be binding in its entirety and directly applicable in all Member States .

3) Applicable to groats and meal of maize imported from non-member countries

4) Applicable to intra-Community trade in groats and meal of maize intended for the brewing industry (cf. Regulation (EEC) No 1570 /78 (OJ No L 185 , 7 . 7 . 1978 , p. 22)).

5) The monetary compensatory amount shall apply to products whose starch content is not less than 85 % by weight. For products with a starch content lower than 85 % by weight, this compensatory amount shall be multiplied by a coefficient calculated by means of the following formula : a. c = x 1,176 1 000 (C = coefficient ; a = content by weight of starch, expressed as dry matter, per 1 000 kg of the product). When completing the customs formalities, the applicant must state in the declaration provided for this purpose the content by weight of starch, expressed as dry matter, per 1 000 kg of the product.

6) The monetary compensatory amount shall apply to the product whose starch content is not less than 78 % by weight. For the product with a starch content lower than 78 % by weight, this compensatory amount shall be multiplied by a coefficient calculated by means of the following formula : a C = x 1,282 1 000 (C = coefficient ; a = content by weight of starch, expressed as dry matter, per 1 000 kg of the product). When completing the customs formalities, the applicant must state in the declaration provided for this purpose the content by weight of starch, expressed as dry matter, per 1 000 kg of the product.

7) Pursuant to Regulation (EEC) No 2730 /75 , the product falling within subheading 17.02 B I is subject to the same compensa tory amount as products falling within subheading 17.02 B II .

8) If the product contains powdered or granulated milk (excluding whey), the amount shown shall be increased by 10 times the supplementary amount shown in the table in note (4) of part 5 of this Annex in respect of 'more than 12 % but less than 30 % ' or '30 % or more but less than 50 % ', in accordance with the skimmed-milk powder contained in the finished product. In this respect, the first two paragraphs below the table shown in note (6) of part 5 shall also apply. When completing the customs formalities, the party concerned shall, in the declaration provided for this purpose, state in particular the content, expressed in actual weight per tonne of finished product, of : — powdered or granulated milk (excluding whey), — powdered or granulated whey, — added casein and / or caseinate . (') In the case of products containing products falling within heading No 07.06 or subheading 11.04 C of the Common Customs Tariff, no monetary compensatory amount shall be granted on tne cereal constituent. However, the amounts indicated shall apply if compensatory amounts are due to be levied .

When completing : — customs export formalities carried out in a Member State the currency of which has appreciated, — customs import formalities carried out in a Member State the currency of which has depreciated, — customs export formalities carried out in a Member State making use of the option provided in Article 2a of Regulation (EEC) No 974 / 71 , the applicant must state in the declaration provided for this purpose the complete composition of the product and the exact content by weight of non-milk constituents broken down by tariff heading.

In trade with non-member countries, the coefficient 1,79 shall be applied to the supplementary amounts indicated above. In intra-Community trade and trade with non-member countries the supplementary amounts specified above shall, if the products contain skimmed-milk powder purchased under the terms of Regulations (EEC) No 368 / 77 (OJ No L 52, 24 . 2 . 1977), (EEC) No 443 / 77 (OJ No L 58 , 3 . 3 . 1977) and (EEC) No 1844 /77 (OJ No L 205 , 11 . 8 . 1977) and more than 9,0 grams of iron and/or 1,2 grams of copper per 100 kilograms, be multiplied by the coefficient 0,27 . This provision shall apply to trade in products containing fish meal up to 31 December 1983 . In intra-Community trade, where the product has not been produced in accordance with Regulation (EEC) No 1725 / 79 (OJ No L 199 , 7. 8 . 1979), the coefficient 1,79 shall be applied to the supplementary amounts indicated above . However, this coefficient shall not be applied to products consigned to Italy from another Member State in accordance with Regu lation (EEC) No 1624/ 76 (OJ No L 180 , 6 . 7 . 1976).
