opening and providing for the administration of a Community tariff quota for apricot pulp falling within code No ex 2008 50 91 of the combined nomenclature and originating in Tunisia ( 1988 )

THE COUNCIL OF THE EUROPEAN COMMUNITIES , of the Community and Statistics of Trade between Member States ; whereas, from the date given above, the combined nomenclature should be used for the description of the Having regard to the Treaty establishing the European products covered by this Regulation; Economic Community , and in particular Article 113 thereof, Whereas equal and continuous access to the abcrvementioned quota should be ensured for all Community importers and the rate laid down for the quota should be applied Having regard to the proposal from the Commission , consistently to all imports of the product in question into all the Member States until the quota is exhausted ; whereas , in the present case , this quota should not be allocated among the Member States , without prejudice to the drawing against Whereas the Cooperation Agreement between the European the quota volume of such quantities as they may need, under Economic Community and the Republic of Tunisia (*), as the conditions and according to the procedure specified in supplemented by the Additional Protocol to that Article 1 ( 2 ); whereas this method of administration requires Agreement ( 2 ), provides for the opening by the Community close cooperation between the Member States and the of an annual Community tariff quota of 4 300 tonnes of Commission and the latter must in particular be able to apricot pulp falling within code No ex 2008 50 91 of the monitor the rate at which the quota is used and inform the combined nomenclature and originating in Tunisia ; Member States accordingly;

Whereas , within the limits of this tariff quota, customs duties Whereas, since the Kingdom of Belgium , the Kingdom of the Netherlands and the Grand Duchy of Luxembourg are united are to be abolished progressively over the same periods and in accordance with the same timetables as those laid down in within and jointly represented by the Benelux Economic Articles 75 and 243 of the Act of Accession of Spain and Union , any operation relating to the administration of the Portugal ; whereas , for 1988 , the quota duty is to be equal to quota shares allocated to that economic union may be carried 62,5% of the customs duty actually applied in respect of out by any of its members , third countries ; whereas , within the limits of this tariff quota , the Kingdom of Spain and the Portuguese Republic are to apply customs duties calculated in accordance with Council Regulation (EEC ) No 2573 / 87 of 11 August 1987 laying down the arrangements for trade between Spain and Portugal HAS ADOPTED THIS REGULATION : on the one hand and Algeria , Egypt , Jordan , Lebanon , Tunisia and Turkey on the other ( 3 ); whereas the Community tariff quota in question should therefore be Article 1 opened for 1988 ;

1 . From 1 January to 31 December 1988 , the customs Whereas the Community has adopted, with effect from duty applicable to imports into the Community of the 1 January 1988 , a combined nomenclature for goods which following products originating in Tunisia shall be suspended meets the requirements of the Common Customs Tariff and at the level indicated and within the limits of a Community the Nomenclature of Goods for the External Trade Statistics tariff quota as shown below:

Within the limits of this tariff quota , the Kingdom of Spain 3 . Member States shall charge imports of the said goods and the Portuguese Republic shall apply customs duties against their drawings as and when the goods are entered calculated in accordance with Regulation ( EEC ) No with the customs authorities for free circulation . 2573 / 87 . 4 .
