COMMISSION REGULATION ( EEC ) No 2155 / 88 of 19 July 1988 determining the amounts of the variable components and additional duties applicable from 1 August to 31 October 1988 on the importation into the Community of goods covered by Regulation (EEC) No 3033 / 80

THE COMMISSION OF THE EUROPEAN COMMUNITIES ,

Having regard to the Treaty establishing the European Economic Community ,

Having regard to Council Regulation (EEC) No 3033 / 80 of 11 November 1980 laying down the trade arrangements applicable to certain goods resulting from the processing of agricultural products ( x ), as amended by Regulation (EEC) No 3743 / 87 ( 2 ), and in particular Articles 6 and 8 thereof,

Having regard to the 1985 Act of Accession , and in particular Articles 53 and 213 thereof,

Whereas the rules for calculating the variable component applicable to each of the goods covered by Regulation (EEC) No 3033 / 80 are laid down in Article 6 ( 1 ) and ( 2) of that Regulation ;

Whereas Council Regulation (EEC ) No 3034 / 80 ( 3 ), as amended by Regulation (EEC) No 4091 / 87 (4 ), fixes the quantities of the basic products considered as having been used in the manufacture of goods covered by Regulation (EEC) No 3033 / 80 ;

Whereas, in accordance with the second indents of Articles 53 ( 1 ) and 213 ( 1 ) of the Act, the variable component applicable to imports of goods covered by Regulation (EEC) No 3033 / 80 into the two new Member States from third countries is to be increased or reduced , as the case may be, by an accession compensatory amount;

Whereas the average threshold prices to be taken into account for the period of August, September, October 1988 for the basic products specified in Article 2 of Regulation (EEC ) No 3033 / 80 are as follows : Cereals (ECU/100 kg)

Whereas the first subparagraph of Article 6 (3 ) of Regulation (EEC) No 3033 / 80 provides that where, pursuant to the Regulations on the common organization of markets, a production refund or an aid is applicable in all Member States to basic products or to products assimilated thereto under Article 3 of that Regulation, the amount of the variable component shall be calculated by reference to the price resulting from the application of those measures instead of by reference to the average threshold price; whereas Article 3 of Regulation (EEC) No 3034 / 80 specifies the goods to which these provisions are applicable ;

Whereas the first subparagraph of Article 1 ( 1 ) of Council Regulation (EEC) No 2742 / 75 of 29 October 1975 on production refunds for cereals and rice ( 1 ), as last amended by Regulation (EEC) No 1009 / 86 (2), provides that Member States shall grant a production refund on maize for the manufacture of starch of 1 ECU per 100 kilograms;

Whereas, as regards the basic products specified in Article 2 of Regulation (EEC) No 3033 / 80 , the averages , as calculated for the period comprising the months of May and June and the first 10 days of July 1988 cif prices (excluding special cif prices) or, as the case may be, free-at-frontier prices, used in fixing the levies applicable to each such basic product , are as follows:

Whereas the Common Customs Tariff provides, in the case of certain goods covered by Regulation (EEC ) No 3033 / 80, for a maximum duty comprising an additional duty on their sugar content expressed in terms of sucrose (AD S / Z ) or on their flour content (AD F / M ); whereas the rules for calculating such additional duties are set out in Article 8 (2) and ( 3 ) of that Regulation; whereas , pursuant to Article 8 (4) of that same Regulation, the Commission is to determine each quarter the amount of the additional duties and the price differences used in calculating those additional duties;

Whereas the average threshold prices for common wheat flour and for rye flour to be taken into consideration for the months of August, September and October 1988 are as follows : (ECU/ 100 kg)

HAS ADOPTED THIS REGULATION :

Article1¶

1 . From 1 August to 31 October 1988 in respect of goods covered by Regulation (EEC ) No 3033 / 80 , the variable components applicable on importation into the Community shall be as specified in Annex I , subject to the application of the 'accession' compensatory amounts provided for in Articles 53 ( 1 ) and 213 ( 1 ) of the Act of Accession of 1985 .

2 . From 1 August to 31 October 1988 the amount of additional duties as referred to in Article 8 ( 2 ) of Regulation (EEC ) No 3033 / 80 on various kinds of sugar expressed as sucrose (AD S / Z), or on flour (AD F / M), applicable on importation into the Community , shall be as specified in Annex II .

Article2¶

From 1 August to 31 October 1988 the differences in prices for the basic products, as referred to in Articles 6 (2) and (3 ) and 8 (2) (a) of Regulation (EEC) No 3033 / 80, shall be as specified in Annex III .

Article3¶

This Regulation shall enter into force on 1 August 1988 .

This Regulation shall be binding in its entirety and directly applicable in all Member States .

(') Starch : Glucose The content of the goods (as presented) in starch , its degradation products i.e. all the polymers of glucose and the glucose, determined as glucose and expressed as starch (on a dry matter basis, 100 % purity; factor for conversion of glucose to starch: 0,9). However , where a mixture of glucose and fructose is declared ( in whatever form) or is found to be present in the goods , the amount of glucose to be included in the above calculation is that which is in excess of the fructose content of the goods. ( 2 ) Sucrose/ Invert sugar / Isoglucose: The content of the goods (as presented), in sucrose, together with the sucrose which results from expressing as sucrose any mixture of glucose and fructose (the sum of the amounts of these two sugars multiplied by 0,95 ), which is declared (in whatever form) or found to be present in the goods. However, where the fructose content of the goods is less than the glucose content, the amount of glucose to be included in the above calculation shall be an amount equal by weight, to that of fructose. Note: In all cases, where a hydrolysis product of lactose is declared , and / or galactose is found to be present among the sugars, then the amount of glucose equal to that of galactose is deducted from the total glucose content before any other calculations are carried out.
