COMMISSION REGULATION (EEC) No 469/89 of 24 February 1989 on the sale by the procedure laid down in Regulation (EEC) No 2539/84 of beef held by certain intervention agencies and intended for processing within the Community

THE COMMISSION OF THE EUROPEAN COMMUNITIES, HAS ADOPTED THIS REGULATION :

Having regard to the Treaty establishing the European Article 1 Economic Community,

1 . The following approximate quantities of beef shall be put up for sale for processing within the Community : Having regard to Council Regulation (EEC) No 805/68 of 27 June 1968 on the common organization of the market in beef and veal ('), as last amended by Regulation (EEC) (a) bone-in hindquarters : No 4132/88 (2), and in particular Article 7 (3) thereof, — 1 000 tonnes of bone-in beef held by the Belgian intervention agency and bought in before 1 May 1987, Whereas Commission Regulation (EEC) No 2539/84 of 5 — 2 000 tonnes of bone-in beef held by the Irish September 1984 laying down detailed rules for certain intervention agency and bought in before 1 July sales of frozen beef held by the intervention agencies (3), 1987, as amended by Regulation (EEC) No 1809/87 (4), has provided for the possibility of applying a two-stage — 3 000 tonnes of bone-in beef held by the German procedure when selling beef from intervention stocks ; intervention agency and bought in before 1 April 1987, — 3 000 tonnes of bone-in beef held by the Dutch Whereas certain intervention agencies hold substantial intervention agency and bought in before 1 stocks of intervention meat ; whereas an extension of the February 1987 ; period of storage should be avoided on account of the ensuing high costs ; whereas, in the present market (b) bone-in forequarters : situation, there are outlets for such meat for processing in — 500 tonnes of bone-in beef held by the Spanish the Community ; intervention agency and bought in before 1 July 1988, Whereas such sales should be made in accordance with — 2 000 tonnes of bone-in beef held by the German Commission Regulations (EEC) No 2539/84, (EEC) No intervention agency and bought in before 1 June 569/88 (5), as last amended by Regulation (EEC) No 1988, 148/89 («), and (EEC) No 2182/77 Q, as last amended by — 600 tonnes of bone-in beef held by the Belgian Regulation (EEC) No 3988/87 (8), subject to certain special intervention agency and bought in before 1 June exceptions on account of the particular use to which the 1988, products in question are to be put ; — 500 tonnes of bone-in beef held by the Irish intervention agency and bought in before 1 July 1988, Whereas Commission Regulation (EEC) No 3615/88 should be repealed (') ; — 3 000 tonnes of bone-in beef held by the Italian intervention agency and bought in before 1 January 1987, Whereas the measures provided for in this Regulation are — 1 500 tonnes of bone-in beef held by the Dutch in accordance with the opinion of the Management intervention agency and bought in before 1 June Committee for Beef and Veal, 1988 ,

— 1 000 tonnes of boned beef held by the United within the period referred to in Article 5 (1 ) of the Kingdom intervention agency and bought in abovementioned Regulation, before 1 July 1988, — a precise indication of the establishment or establishments where the meat which has been — 800 tonnes of boned beef held by the Italian intervention agency and bought in before 1 purchased will be processed. Article2¶

For the purpose of this Regulation, 100 kilograms of 1 . Notwithstanding Article 3 ( 1 ) and (2) of Regulation bone-in hindquarters equals 64 kilograms of boneless (EEC) No 21 82/77, the tender or application to purchase : meat after removal of the fillet and the striploin. (a) shall be valid only if presented by a natural or legal person who, for at least 12 months, has been engaged Article 5 in the processing of products containing beef and who is entered in a public register of a Member State ; Regulation (EEC) No 3615/88 is hereby repealed.

(b) must be accompained by : Article 6 — a written undertaking by the applicant to process the meat purchased into products specified in This Regulation shall enter into force on 28 February Article 1 (1 ) of Regulation (EEC) No 2182/77 1989 .

This Regulation shall be binding in its entirety and directly applicable in all Member States .
