on the application of Decision No 2/89 of the EEC/EFTA Joint Committee on common transit amending the Convention of 20 May 1987 on a common transit procedure

THE COUNCIL OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Economic Community, and in particular Article 113 thereof,

Having regard to the proposal from the Commission,

Whereas Article 15 (3) (b) of the Convention between the European Economic Community, the Republic of Austria, the Republic of Finland, the Republic of Iceland, the Kingdom of Norway, the Kingdom of Sweden and the Swiss Confederation on a common transit procedure (1) empowers the Joint Committee established by that Convention to adopt by decision amendments to the definition of the ecu as set out in Article 10 (3) of the Convention;

Whereas the Joint Committee has decided to amend Article 10 (3) of the said Convention in order to take account of the recent change in Community rules governing the definition of the ecu;

Whereas that amendment was the subject of Decision No 2/89 of the Joint Committee; whereas measures to implement that Decision should therefore be taken,

HAS ADOPTED THIS REGULATION:

Article1¶

Decision No 2/89 of the EEC/EFTA Joint Committee on common transit amending the Convention of 20 May 1987 on a common transit procedure shall apply within the Community.

The text of the Decision is attached to this Regulation.

Article2¶

This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Communities.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

DECISION No 2/89 OF THE EEC/EFTA JOINT COMMITTEE ON COMMON TRANSIT

of 8 December 1989

amending the Convention of 20 May 1987 on a common transit procedure

THE JOINT COMMITTEE,

Having regard to the Convention of 20 May 1987 on a common transit procedure, and in particular Article 15 (3) (b) thereof,

Whereas for the purposes of the Convention the ecu is defined in the same way as it is in the Community rules;

Whereas those rules were recently changed, so that the ecu has been composed differently since 21 September 1989; whereas the Convention should therefore be adapted to take account of the new composition of the ecu,

HAS ADOPTED THIS REGULATION:

Article1¶

In Article 10 of the Convention, paragraph 3 is hereby replaced by the following:

'3. For the purposes of the flat rate guarantee as provided for in Appendices I and II, the "ecu" means the total of the following amounts:

1.2 // 0,6242 // German mark, // 0,08784 // Pound sterling, // 1,332 // French francs, // 151,8 // Italian lira, // 0,2198 // Dutch guilder, // 3,301 // Belgian francs, // 0,130 // Luxembourg franc, // 0,1976 // Danish krone, // 0,008552 // Irisch pound, // 1,440 // Greek drachmas, // 6,885 // Spanish pesetas, // 1,393 // Portuguese escudos.

The value of the ecu in a given currency shall be equal to the sum of the exchange values in that currency of the amounts set out in the first subparagraph.'

Article2¶

This Decision shall enter into force on 1 May 1990.
