om anpassning till tekniska framsteg för nionde gången av bilaga I till rådets direktiv 76/769/EEG om tillnärmning av medlemsstaternas lagar och andra författningar om begränsning av användning och utsläppande på marknaden av vissa farliga ämnen och preparat (tennorganiska föreningar)

EUROPEISKA GEMENSKAPERNAS KOMMISSION HAR ANTAGIT DETTA DIREKTIV
med beaktande av Fördraget om upprättandet av Europeiska gemenskapen,
med beaktande av rådets direktiv 76/769/EEG av den 27 juli 1976 om tillnärmning av medlemsstaternas lagar och andra författningar om begränsning av användning och utsläppande på marknaden av vissa farliga ämnen och preparat (beredningar)(1), senast ändrat genom kommissionens direktiv 2001/91/EG(2), särskilt artikel 2a i detta, införd genom rådets direktiv 89/678/EEG(3), och
av följande skäl:
Skälen nedan är grundrättsaktens. Ändringsrättsakternas skäl: förordning (EU) nr 1907/2006.
(1) Genom kommissionens direktiv 1999/51/EG(4) om anpassning till tekniska framsteg för femte gången av bilaga I till rådets direktiv 76/769/EEG förbjuds användningen av tennorganiska föreningar i antifoulingfärger avsedda för fartygsskrov med en total längd som understiger 25 meter samt på alla båtar oavsett längd som främst är avsedda att användas på inre vattenvägar och sjöar. Enligt direktivet skall bestämmelserna om tennorganiska föreningar i antifoulingprodukter ses över med hänsyn tagen till utvecklingen inom Internationella sjöfartsorganisationen (IMO) och särskilt uppmaningen från IMO:s kommitté för skydd av den marina miljön som verkar för ett internationellt förbud mot användning av tennorganiska föreningar som fungerar som biocider i antifoulingfärg avsedd för fartyg från och med den 1 januari 2003.
(2) Vetenskapliga studier har visat att vissa antifoulingsystem som används på skepp innebär en påtaglig risk för vattenmiljön. En internationell IMO-konvention om skadliga antifoulingsystem (International Convention on the Control of Harmful Antifouling Systems), som antogs på IMO:s diplomatkonferens i oktober 2001, innehåller ett förbud från och med den 1 januari 2003 att på skepp anbringa eller återanbringa tennorganiska föreningar som fungerar som biocider i antifoulingsystem.
(3) Förbudet mot användning eller återanvändning av tennorganiska föreningar påverkar direkt den inre marknadens funktion på området tennorganiska föreningar och det är därför nödvändigt att tillnärma medlemsstaternas lagar på detta område, och följaktligen att ändra bilaga I till direktiv 76/769/EEG och i synnerhet direktiv 1999/51/EG.
(4) En förordning från Europaparlamentet och rådet kommer att behandla åtgärder för fartyg som behandlats med tennorganiska föreningar.
(5) Rådets och Europaparlamentets direktiv 94/25/EG(5) reglerar fritidsbåtar och dessa skall också omfattas av samma restriktioner som övriga båtar.
(6) Detta direktiv påverkar inte gemenskapens lagstiftning om minimikrav för arbetarskydd i rådets direktiv 89/391/EEG(6) och i särdirektiv som grundas på det direktivet, i synnerhet rådets direktiv 90/394/EEG(7), senast ändrat genom direktiv 1999/38/EG(8), och rådets direktiv 98/24/EG(9) om skydd av arbetstagares hälsa och säkerhet mot risker som har samband med kemiska agenser i arbetet.
(7) Detta direktiv påverkar inte gemenskapens lagstiftning om användningen av tennorganiska föreningar i plaster som är avsedda att komma i kontakt med livsmedel enligt kommissionens direktiv 90/128/EEG av den 23 februari 1990 om material och produkter av plast som är avsedda att komma i kontakt med livsmedel(10), senast ändrat genom direktiv 2002/17/EG(11).
(8) De åtgärder som föreskrivs i detta direktiv är förenliga med yttrandet från kommittén för anpassning till teknisk utveckling av direktiven om avskaffandet av tekniska handelshinder för farliga ämnen och preparat.
HÄRIGENOM FÖRESKRIVS FÖLJANDE.
THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Community,
Having regard to Council Directive 76/769/EEC of 27 July 1976 on the approximation of the laws, regulations and administrative provisions of the Member States relating to restrictions on the marketing and use of certain dangerous substances and preparations, as last amended by Commission Directive 2001/91/EC, and in particular Article 2a thereof, introduced by Council Directive 89/678/EEC,
(1) Commission Directive 1999/51/EC adapting to technical progress for the fifth time Annex I to Directive 76/769/EEC, prohibits the use of organostannic compounds in antifouling applications on the hulls of boats of less than twenty-five metres and vessels of any length used predominantly on inland waters. This Directive calls for a review of the provisions in relation to organostannic compounds used in antifouling products taking full account of developments within the International Maritime Organisation (IMO) and in particular, the call of their Marine Environment Protection Committee for a global prohibition of the application of organostannic compounds which act as biocides in antifouling systems on ships by 1 January 2003.
(2) Scientific studies have shown that certain antifouling systems used on ships pose a substantial risk to the aquatic environment. An IMO International Convention on the Control of Harmful Antifouling Systems, agreed at an IMO Diplomatic Conference in October 2001, includes a prohibition from 1 January 2003, on the application or re-application to ships of organotin compounds which act as biocides in antifouling systems.
(3) The prohibition of application or re-application of organostannic compounds directly affects the functioning of the internal market in organostannic compounds and it is therefore necessary to approximate the laws of the Member States in this field and consequently to amend Annex I to Directive 76/769/EEC and in particular, Directive 1999/51/EC.
(4) A Regulation of the European Parliament and the Council will address measures in relation to vessels treated with organostanic compounds.
(5) Directive 94/25/EC of the European Parliament and of the Council regulates pleasure craft and these craft shall also be subject to the same restrictions as other boats.
(6) This Directive does not affect Community legislation laying down minimum requirements for the protection of workers contained in Council Directive 89/391/EEC and in individual directives based thereon, in particular Council Directive 90/394/EEC, as last amended by Directive 1999/38/EC, and Council Directive 98/24/EC on protection of health and safety of workers from chemical agents at work.
(7) This Directive does not affect Community legislation covering the use of organostannic compounds in food-contact plastics contained in Commission Directive 90/128/EEC of 23 February 1990 relating to plastics materials and articles intended to come into contact with foodstuffs, as last amended by Directive 2002/17/EC.
(8) The measures provided for in this Directive are in accordance with the opinion of the Committee for the adaptation to technical progress of directives on the removal of technical barriers to trade in dangerous substances and preparations,
HAS ADOPTED THIS DIRECTIVE:
Article1¶

Annex I to Directive 76/769/EEC is hereby adapted to technical progress as set out in the Annex hereto.
Article2¶

Member States shall adopt and publish the provisions necessary to comply with this Directive by 31 October 2002 at the latest. They shall forthwith inform the Commission thereof. They shall apply these provisions on 1 January 2003.
When Member States adopt those provisions, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. Member States shall determine how such reference is to be made.

ANNEX
In Annex I to Directive 76/769/EEC, point 21 shall be replaced by the following point:
‘Organostannic compounds 1. May not be placed on the market for use as substances and constituents of preparations when acting as biocides in free association paint. 2. May not be placed on the market or used as substances and constituents of preparations which act as biocides to prevent the fouling by microorganisms, plants or animals of: (a) all craft irrespective of their length intended for use in marine, coastal, estuarine and inland waterways and lakes; (b) cages, floats, nets and any other appliances or equipment used for fish or shellfish farming; (c) any totally or partly submerged appliance or equipment. 3. May not be used as substances and constituents of preparations intended for use in the treatment of industrial waters.’
