Commission Regulation (EC) No 2187/2004 of 20 December 2004 amending Regulation (EC) No 1614/2000 derogating from Regulation (EEC) No 2454/93 in respect of the definition of the concept of originating products used for the purposes of the scheme of generalised preferences to take account of the special situation of Cambodia regarding certain exports of textiles to the Community
EUROPEISKA GEMENSKAPERNAS KOMMISSION HAR ANTAGIT DENNA FÖRORDNING
med beaktande av Fördraget om upprättandet av Europeiska gemenskapen,
med beaktande av rådets förordning (EEG) nr 2913/92 av den 12 oktober 1992 om inrättandet av en tullkodex för gemenskapen, särskilt artikel 247 i denna,
med beaktande av kommissionens förordning (EEG) nr 2454/93 av den 2 juli 1993 om tillämpningsföreskrifter för rådets förordning (EEG) nr 2913/92 om inrättandet av en tullkodex för gemenskapen, särskilt artikel 76 i denna, och
(1) Genom rådets förordning (EG) nr 2501/2001 av den 10 december 2001 om tillämpning av en ordning med allmänna tullförmåner under tiden 1 januari 2002–31 december 2004, dvs. EU:s allmänna preferenssystem, beviljade gemenskapen Kambodja allmänna tullförmåner.
(2) I förordning (EEG) nr 2454/93 fastställs definitionen av begreppet ”ursprungsvaror” inom ramen för systemet för allmän förmånsbehandling, dvs. EU:s allmänna preferenssystem. Förordning (EEG) nr 2454/93 innehåller dock bestämmelser som gör det möjligt att göra undantag för de minst utvecklade länder som omfattas av systemet för allmän förmånsbehandling när dessa begär detta hos gemenskapen.
(3) Kambodja har åtnjutit ett sådant undantag för vissa textilier sedan 1997, senast genom kommissionens förordning (EG) nr 1614/2000 av den 24 juli 2000 om undantag från förordning (EEG) nr 2454/93 med avseende på definitionen av begreppet ”ursprungsvaror” som fastställs inom ramen för systemet för allmän förmånsbehandling för att ta hänsyn till Kambodjas särskilda situation när det gäller vissa textilprodukter som exporteras från detta land till gemenskapen, ändrad genom förordning (EG) nr 292/2002 som förlängde dess giltighet till den 31 december 2004. Genom en skrivelse av den 10 juni 2004 lämnade Kambodja in en begäran om en förlängning av detta undantag.
(4) Kommissionen har prövat den begäran som lämnats av Kambodja och har funnit att den är tillräckligt underbyggd.
(5) När giltighetstiden för förordning (EG) nr 1614/2000 förlängdes var tanken att förordningen skulle upphöra att gälla samma dag som det var planerat att det nuvarande systemet för allmän förmånsbehandling skulle upphöra att gälla. Genom rådets förordning (EG) nr 2211/2003 förlängdes emellertid giltighetstiden för systemet för allmän förmånsbehandling med ytterligare ett år, till och med den 31 december 2005.
(6) Den 18 december 2003 offentliggjorde kommissionen en grönbok om hur ursprungsreglerna i förmånsordningarna på handelsområdet skall se ut i framtiden som inledde en omfattande debatt om frågan. Den 7 juli 2004 offentliggjorde kommissionen ett meddelande till rådet, Europaparlamentet och Europeiska ekonomiska och sociala kommittén med titeln ”Utvecklingsländer, internationell handel och hållbar utveckling: Gemenskapens ordning med allmänna tullförmåner under perioden 2006–2015”, i vilket behovet av förändrade ursprungsregler också bekräftades. Inget beslut har emellertid fattats ännu och inga nya regler kommer att vara ikraft före den 31 december 2004.
(7) En förlängning av undantaget bör inte föregripa eller påverka resultatet av diskussionerna om eventuella nya ursprungsregler för systemet för allmän förmånsbehandling. Med hänsyn till de handlare både i Kambodja och i gemenskapen som ingår kontrakt och till behovet av en stabil och hållbar utveckling i den kambodjanska industrin, beträffande pågående investeringar och sysselsättning, krävs det dock att undantaget förlängs under tillräckligt lång tid för att fullfölja eller ingå långtidskontrakt, samtidigt som övergången till eventuella nya ursprungsregler underlättas.
(8) Bestämmelserna i förordning (EG) nr 1614/2000, särskilt införandet av vissa årliga begränsningar i fråga om kvantiteterna, vilka fastställts med hänsyn till gemenskapsmarknadens förmåga att absorbera sådana produkter med ursprung i Kambodja, detta lands exportkapacitet och de faktiska handelsströmmar som konstaterats, har till syfte att förhindra skada för motsvarande gemenskapsindustrier.
(9) Undantaget bör därför förlängas till och med den 31 december 2006. För att säkerställa att både Kambodja och andra minst utvecklade länder behandlas rättvist bör det fortsatta behovet av undantaget ses över så snart eventuella nya ursprungsregler har antagits inom ramen för det nya systemet för allmän förmånsbehandling.
(10) Förordning (EG) nr 1614/2000 bör därför ändras i enlighet med detta.
(11) De åtgärder som föreskrivs i denna förordning är förenliga med yttrandet från Tullkodexkommittén.
HÄRIGENOM FÖRESKRIVS FÖLJANDE.
THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Community,
Having regard to Council Regulation (EEC) No 2913/92 of 12 October 1992 establishing the Community Customs Code, and in particular Article 247 thereof,
Having regard to Commission Regulation (EEC) No 2454/93 of 2 July 1993 laying down provisions for the implementation of Council Regulation (EEC) No 2913/92 establishing the Community Customs Code, and in particular Article 76 thereof,
(1) By Council Regulation (EC) No 2501/2001 of 10 December 2001 applying a scheme of generalised tariff preferences for the period 1 January 2002 to 31 December 2004, the Community granted generalised tariff preferences to Cambodia.
(2) Regulation (EEC) No 2454/93 of 2 July 1993 establishes the definition of the concept of originating products to be used for the purposes of the scheme of generalised tariff preferences (GSP). However, Regulation (EEC) No 2454/93 provides for derogations in favour of least-developed GSP-beneficiary countries which submit an appropriate request to that effect to the Community.
(3) Cambodia has benefited from such a derogation for certain textiles since 1997, in the last instance by virtue of Regulation (EC) No 1614/2000 of 24 July 2000 derogating from Regulation (EEC) No 2454/93 in respect of the definition of the concept of originating products used for the purposes of the scheme of generalised preferences to take account of the special situation of Cambodia regarding certain exports of textiles to the Community, as amended by Regulation No 292/2002, which extended its validity until 31 December 2004. By letter dated 10 June 2004, Cambodia has submitted a request for the renewal of this derogation.
(4) The request submitted by Cambodia has been considered by the Commission and has been found to be duly substantiated.
(5) When the validity of Regulation No 1614/2000 was extended, it was considered that its expiry should coincide with the ending of the current GSP scheme, which was due to end on that date. However, Council Regulation No 2211/2003 extended the validity of the GSP scheme for a further year, until 31 December 2005.
(6) On 18 December 2003 the Commission published a Green Paper on the future of rules of origin in preferential trade arrangements which opened a wide-ranging debate on the subject. On 7 July 2004 it published a Communication to the Council, the European Parliament and the Economic and Social Committee entitled ‘Developing countries, international trade and sustainable development: the function of the Community’s generalised system of preferences (GSP) for the 10-year period from 2006 to 2015’, which also acknowledged the need for change in rules of origin. However, no decisions have yet been taken and no new rules will be in place before 31 December 2004.
(7) A prolongation of the derogation should not pre-judge or prejudice the outcome of discussions on possible new rules of origin for GSP. However, the interests of traders concluding contracts both in Nepal and in the Community, as well as the stability and the sustained development of the Nepalese industry in terms of ongoing investment and employment, require that the derogation should be prolonged for a period of time sufficient to permit the continuation or conclusion of longer-term contracts, while facilitating the transition to possible new rules of origin for GSP.
(8) The provisions of Regulation (EC) No 1614/2000, in particular the existence of quantitative limits, which apply on an annual basis, reflecting the Community market's capacity to absorb the Cambodian products, Cambodia’s export capacity and actual recorded trade flows, were designed to prevent injury to the corresponding branches of Community industry.
(9) The derogation should therefore be renewed until 31 December 2006. However, in order to ensure fair treatment both for Cambodia and for other least developed countries, the continuing need for the derogation should be reviewed once any new rules of origin are adopted in the context of the new generalised system of preferences.
(10) Regulation (EC) No 1614/2000 should therefore be amended accordingly.
(11) The measures provided for in this Regulation are in accordance with the opinion of the Customs Code Committee,
HAS ADOPTED THIS REGULATION:

Regulation (EC) No 1614/2000 is amended as follows:
in Article 2, ‘31 December 2004’ is replaced by ‘31 December 2006’ and the following paragraph is added:
‘The continuing need for the derogation shall however be reviewed not later than 31 December 2005, in accordance with the new provisions to be adopted with regard to the generalised system of preferences and the rules of origin related thereto’.

It shall apply from 1 January 2005.
