EUROPEISKA KOMMISSIONEN HAR ANTAGIT DENNA FÖRORDNING

med beaktande av fördraget om Europeiska unionens funktionssätt,

med beaktande av Europaparlamentets och rådets förordning (EU) nr 211/2011 av den 16 februari 2011 om medborgarinitiativet, särskilt artikel 16, och

(1) I artikel 4.1 i förordning (EU) nr 211/2011 anges att organisatörerna av ett föreslaget medborgarinitiativ ska registrera initiativet hos kommissionen och lämna den information som anges i bilaga II till förordningen.

(2) Informationen i bilaga II behöver ändras i syfte att underlätta kommissionens kontroll av att de kriterier för registrering som anges i artikel 4.2 a är uppfyllda, säkerställa en korrekt administrativ behandling av begäranden om registrering samt underlätta kommunikationen mellan organisatörerna och kommissionen under hela förfarandet med ett medborgarinitiativ.

(3) Sex medlemsstater har begärt ändringarna i de uppgifter som krävs i de formulär som återfinns i bilaga III till förordning (EU) nr 211/2011.

(4) Kommissionen har befogenhet att ändra bilagorna II och III till förordningen i enlighet med artikel 290 i EUF-fördraget. När det gäller bilaga III bör kommissionen beakta de uppgifter som den får från medlemsstaterna.

(5) Flera organisatörer av initiativ som är registrerades vid kommissionen samlar för närvarande in stödförklaringar i enlighet med artikel 5 i förordning (EU) nr 211/2011, varför det är nödvändigt att tillåta dem att använda både de formulär som återfinns i bilaga II till den här förordningen och deras tidigare versioner.

HÄRIGENOM FÖRESKRIVS FÖLJANDE.

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 211/2011 of the European Parliament and of the Council of 16 February 2011 on the citizens’ initiative, and in particular Article 16 thereof,

(1) Article 4(1) of Regulation (EU) No 211/2011 provides that the organisers of a proposed citizens’ initiative are required to register it with the Commission, providing the information set out in Annex II to that Regulation.

(2) The information in Annex II needs to be modified in order to facilitate the verification by the Commission that the criteria for registration set out in point (a) of Article 4(2) are fulfilled, ensure an appropriate administrative handling of the registration requests and facilitate communication between the organisers and the Commission throughout the citizens’ initiative procedure.

(3) Six Member States requested modifications in the data required in the forms set out in Annex III to Regulation (EU) No 211/2011.

(4) The Commission is empowered to amend Annexes II and III to the Regulation in accordance with Article 290 TFEU. As regards Annex III, the Commission should take into account information forwarded to it by Member States.

(5) Several organisers of initiatives registered with the Commission are currently collecting statements of support in accordance with Article 5 of Regulation (EU) No 211/2011; it is necessary to allow them to equally use the forms as set out in Annex II to this Regulation and their previous versions,

HAS ADOPTED THIS REGULATION:

Article1

Regulation (EU) No 211/2011 is amended as follows:

a) Annex II is replaced by the text set out in Annex I to this Regulation;

b) Annex III is replaced by the text set out in Annex II to this Regulation.

Article2

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

Forms complying with Annex III to Regulation (EU) No 211/2011 in the version in force prior to the entry into force of this Regulation may continue to be used for the collection of statements of support from signatories for proposed citizens’ initiatives which have been registered in accordance with Article 4 of Regulation (EU) No 211/2011 before the date of entry into force of this Regulation.

ANNEX I

‘ANNEX II

REQUIRED INFORMATION FOR REGISTERING A PROPOSED CITIZENS’ INITIATIVE

1. The title of the proposed citizens’ initiative, in no more than 100 characters;

2. The subject matter, in no more than 200 characters;

3. A description of the objectives of the proposed citizens’ initiative on which the Commission is invited to act, in no more than 500 characters;

4. The provisions of the Treaties considered relevant by the organisers for the proposed action;

5. The full names, postal addresses, nationalities and dates of birth of the seven members of the citizens’ committee, indicating specifically the representative and the substitute as well as their e-mail addresses and telephone numbers;

6. Documents that prove the full names, postal addresses, nationalities and dates of birth of each of the seven members of the citizens’ committee;

7. All sources of support and funding for the proposed citizens’ initiative at the time of registration. Organisers may provide more detailed information on the subject, objectives and background to the proposed citizens’ initiative in an annex. They may also, if they wish, submit a draft legal act.
