CONCERNING PRODUCTS REFERRED TO IW SUB-PARAGRAPH ( b )

Article 1

The provisions of the Agreement shall apply to the products listed in Table I.

Article 2

1. In order to take account of differences in the cost of the agricultural raw materials incorporated in the goods specified in the Tables referred to in this Article, the Agreement does not preclude:

(i) the levying, upon import, of a variable component or fixed amount, or the application of internal price compensation measures;

(ii) the application of measures adopted upon export.

2. The price compensation measures shall not exceed the differences between the domestic price and the world märket price of the agricultural raw materials incorporated in the goods concerned. If, however, the domestic price of an agricultural raw material in the country of origin is lower thån the world märket price, the importing country may take this fact into account when calculating the compensatory amounts.

3. The price compensation system as outlined in paragraphs 1 and 2 shall not restrict in any way the pursuance of the respective agricultural policies of the EFTA States and of Romania or the taking of any measures under such policies.

Artjgi<? 2

1. För products listed in Tables II, III, IV, V and VI, the respective EFTA State shall accord to Romania the concessions indicated in those Tables.

2. The treatment to be accorded by leeland is laid down in Table VII. The customs duties are indicated in List 1 and the duties of a fiscal nature in List 2 of the Table, leeland may, however, replace these duties with other price compensation measures in accordance with paragraphs 1 and 2 of Article 2 but any such action shall not result in a treatment less favourable for Romania for products laid down in Table VII thån that accorded by leeland to the European Economic Community.

Article 4

1. For products listed in Table VIII Romania shall accord to the EFTA States the concessions indicated in paragraphs

3 and 4 below.

2. Romania shall define, in accordance with the provisions of paragraphs 1 and 2 of Article 2 and not later thån 1 July 1995, the agricultural element for the products listed in Table VIII. The agricultural element can be replaced by price compensation measures.

3. Duties on imports applicable in Romania, from the date of entry into force of the Agreement until 31 December 1995, to products mentioned in Table VIII, shall be those in force on 30 April 1993, but if as a result of reforms of the Romanian agricultural policy the incidence of the agricultural element is increased, Romania shall inform the Joint Committee, which may accept an increase of the duty concerned to the extent of this incidence.

4. For the products listed in Table VIII Romania shall progressively eliminate the non-agricultural element before

1¶January 2000, in accordance with the timetable established by the Joint Committee.

A r t i g l e 5

1. The EFTA States shall notify Romania and Romania shall notify the EFTA States of all price compensation measures applied under Article 2 of this Protocol.

2. Romania and the EFTA States shall inform each other of all changes in the treatment accorded to the European Economic Community.

The EFTA States and Romania shall review at two-yearly intervals the development of their trade in products covered by this Protocol. A first review shall be held before the end of 1993. In the light of these reviews and taking into account the arrangements between the States Parties to this Agreement and the European Economic Community in this field and in GATT, the EFTA States and Romania shall decide on possible changes to the product coverage of this Protocol as well as on a possible development of the rules concerning price compensation systems.
