REGULATION (EEC) No 1096/71 OF THE COMMISSION of 27 May 1971

concerning applications for the reimbursement of premiums granted by Member States for grubbing apple trees, pear trees and peach trees .

This Regulation shall be binding in its entirety and directly applicable in all Member States .

It is hereby certified that: ( a) the application for premiums were lodged in good and due form by 1 March 1971 ; (b ) the competent authority has registered the beneficiaries ' written undertakings referred to in Article 2 (2) (b ) of Regulation (EEC) No 2517/69 and in the second subparagraph of Article 5 of Regulation (EEC) No 2637/69 ; (c) in conformity with the provisions of Article 7 of Regulation (EEC) No 2637/69, as amended by Article 2 of Regulation (EEC ) No 2656/70, the beneficiaries have furnished proof that they have fulfilled the undertaking referred to in Article 2 (2) (a) of Regulation (EEC) No 2517/69 ; (d) the apple, pear and peach trees for which grubbing premiums have been granted have been grubbed, grubbing effected in 1973 took place by 28 February of that year, and grubbed trees have been made unfit ufor replanting; (e) the conditions laid down in Article 2 ( 1 ) and (2) of Regulation (EEC) No 2637/69 for the grant of grubbing premiums have been fulfilled.
