REGULATION (EEC) No 2728 /71 OF THE COUNCIL

of 20 December 1971 amending, as regards tariff nomenclature, Regulation (EEC) No 1052/68 on the import and export system for products processed from cereals and from rice

THE COUNCIL OF THE EUROPEAN COMMUNITIES , Whereas these amendments concern, inter alia, the Annex to Regulation No 120/67/EEC, and in particular products falling within headings Nos 07.06 and 11.09 of the Common Customs Tariff; whereas, as regards the latter heading relating to gluten, only Having regard to the Treaty establishing the the product derived from wheat should be described European Economic Community ; as gluten since the product derived from maize should, in accordance with international trade practice, be described as a residue of that cereal :

Having regard to Council Regulation No 120/67/EEC1 of 13 June 1967 on the common Whereas Council Regulation ( EEC) No 1052/683 of organisation of the market in cereals, and in 23 July 1968 on the import and export system for particular Articles 14 (3 ), 16 (5 ), 17 and 23 (4) products processed from cereals and from rice, as last thereof ; amended by Regulation (EEC) No 1606/71 ,4 should be amended accordingly ;

Having regard to the proposal from the Commission ; HAS ADOPTED THIS REGULATION :

Article 1 Whereas, in Council Regulation (EEC) No 2727/71 2 of 20 December 1971 amending, as regards tariff 1 . In Article 4 (2), Article 9 ( 1 ), the first indent of nomenclature, Regulation No 23 on the progressive Article 10 ( 1 ) and the Annex to Regulation (EEC) No establishment of a common organisation of the 1052/ 68 , '07.06 A' shall be substituted for ' 07.06 B '. market in fruit and vegetables and Regulations No 136/66/EEC, No 120/67/EEC, No 121 /67/EEC, No 123 /67/EEC, No 1009/67/EEC, (EEC) No 805/68 , 2 . Subheading No ' 02.03 A I ' shall be added to the (EEC) No 2142/70 and (EEC) No 827/68, on the list of headings and subheadings in Articles 5 ( 1 ), 8 common organisation of the markets respectively in ( 1 ) and 9 (3 ) of Regulation ( EEC) No 1052/68 . oils and fats, cereals, pigmeat, poultrymeat, sugar, beef and veal, fishery products and certain products listed in Annex II to the Treaty, amendments were made to the nomenclature of the Common Customs 3 . The Annex to Regulation (EEC) No 1052/68 Tariff; shall be amended as follows :

(a) The following shall be substituted for heading No 11.09 :

Article2¶

This Regulation shall enter into force on the day following its publication in the Official Journal of the European Communities.

It shall apply from 1 January 1972.

This Regulation shall be binding in its entirety and directly applicable in all Member States .
