REGULATION (EEC) No 358/73 OF THE COMMISSION of 31 January 1973 fixing the compensatory amounts for certain types of cereals and rice, and for products processed from cereals and from rice

THE COMMISSION OF THE EUROPEAN applying the coefficients used in calculating the levy ; COMMUNITIES , whereas the reference product for paddy rice and milled rice is husked rice and that for semi-milled rice is milled rice ; whereas the coefficients aforesaid Having regard to the Treaty establishing the European were fixed by Commission Regulation No 467/67/ Economic Community ; EEC (4) of 21 August 1967 fixing the conversion rates, the processing costs and the value of the by-products for the various stages of rice processing, as last Having regard to the Treaty ( x) concerning the amended by Regulation (EEC) No 1499/72 (5) ; Accession of . new Member States to the European whereas application of those coefficients to the Economic Community and the European Atomic compensatory amount for the reference cereal, fixed Energy Community, signed at Brussels on 22 January by Regulation (EEC) No 243/73 gives the compensa­ 1972, and in particular Article 63 ( 1 ) of the Act annexed tory amounts listed in Annex B ; thereto ;

Having regard to Council Regulation (EEC) No 229/ Whereas the compensatory amounts listed in Annex C 73 (2) of 31 January 1973 laying down general rules for are obtained if Articles 74 (2) and 80 (2) of the Act the system of compensatory amounts for cereals and fixing these for certain products , and in particular are applied to the products listed in Article 1 (c) and (d) Article 9 thereof ; of Council Regulation No 120/67/EEC (6) of 13 June 1967 on the common organization of the market in cereals and Article 1 ( 1 ) (c) of Council Regulation Having regard to Council Regulation (EEC) No No 359/67/EEC (7) of 25 July 1967 on the common 243/73 (3) of 31 January 1973 laying down general organization of the market in rice, both Regulations rules for the system of compensatory amounts for as last amended by the Act concerning the conditions rice and fixing these for certain products , and in of Accession and the Adjustments to the Treaties ; particular Article 7 ( 1 ) thereof ;

Whereas pursuant to Article 74 ( 1 ) of the Act the Whereas if compensatory amounts are fixed from the compensatory amounts for cereals, for which no start of the transitional period for the products derived intervention price is fixed , are to be derived falling within heading No 23.07 of the Common from those applicable to the competing cereal for Customs Tariff, listed in Annex A to Regulation which a derived intervention price is fixed ; whereas No 120/67/EEC , the new Member States would such reference cereal was determined by Regulation experience considerable difficulties ; whereas the (EEC) No 229/73 ; whereas the same Regulation fixed fixing of compensatory amounts for such products the coefficients provided for in Article 74 ( 1 ) of the should therefore be postponed ; Act ; whereas application of such coefficients to the compensatory amount for the reference cereals gives the compensatory amounts listed in Annex A ;

HAS ADOPTED THIS REGULATION : 2. The compensatory amounts specified in paragraph 1 shall be applicable until 31 July 1973 for products Article 1 covered by Regulation No 120/67/EEC and until 31 August 1973 for products covered by Regulation 1 . The compensatory amounts applicable in trade No 359/67/EEC . between the Community as originally constituted and the new Member States and, where appropriate, between the new Member States themselves, and the Article 2 compensatory amounts applicable in trade between those States and third countries shall be as shown : The compensatory amounts specified in Articles 1 and 2 (3 ) of Regulation (EEC) No 229/73 are given in — in Annex A, for the products specified in Article Annex A, those specified in Article 1 of Regulation 2 ( 1 ) of Regulation (EEC) No 229/73 ; (EEC) No 243/73 are given in Annex B. — in Annex B, for paddy rice, semi-milled rice and wholly milled rice ; Article 3 — in Annex C, for the products listed in Article 1 (c) and (d) of Regulation No 120/67/EEC and in This Regulation shall enter into force on the day of Article 1 (1 c) of Regulation No 359/67/EEC, its publication in the Official Journal of the European Communities . excluding products falling within heading No 23.07 of the Common Customs Tariff listed in Annex A to Regulation No 120/67/EEt. This Regulation shall apply from 1 February 1973 .

This Regulation shall be binding in its entirety and directly applicable in all Member States .
