REGULATION (EEC) No 376/73 OF THE COMMISSION
of 31 January 1973
amending, as regards the compensatory amounts provided for in the Act of Accession, Regulations (EEC) Nos 1259/72, 1282/72, 1519/72, 1717/72, 2474/72, 2537/72 and 2561/72 relating special sales of butter
THE COMMISSION OF THE EUROPEAN price to the army and similar forces, as amended COMMUNITIES , by Regulation (EEC) No 2369/72 (9) ;
Having regard to the Treaty (*) concerning the Ac Commission Regulation (EEC) No 1519/72 ( 10) cession of new Member States to the European Economic of 14 July 1972 on the sale by tender of butter at Community and the European Atomic Energy reduced prices for the exportation of certain Community, signed at Brussels on 22 January 1972, fat compounds ; and in particular Article 62 ( 1 ) of the Act (2) annexed thereto, hereinafter called the 'Act' ;

Whereas the measures provided for in this Regulation — Commission Regulation (EEC) No 1282/72 (8) of are in accordance with the Opinion of the Manage 21 June 1972 on the sale of butter at a reduced ment Committee for Milk and Milk Products ;

HAS ADOPTED THIS REGULATION : (b) the compensatory amounts provided for in the Accession Treaty shall not be applicable.' Article 1
Article 20 of Regulation (EEC) No 1259/72 is replaced Article 4 ■■ by the following : The following new Article 11a is added to Regulation 'As regards that part of the butter and concentrated (EEC) No 2474/72 : butter specified in Article b ( 1 ) ( a) and ( b) which consists of butter, on sales pursuant to this 'Article 11a Regulation : The compensatory amounts provided for in the (a) the compensatory amounts fixed pursuant to Act annexed to the Accession Treaty shall be Regulation (EEC) No 974/71 shall be multiplied applicable to butter sold pursuant to this Regu lation .' by the coefficient 0-3 : the Commission may, if necessary after this coefficient ;
Article 5 (b) the compensatory amounts provided for in the Act annexed to the Accession Treaty shall not be applicable.' In Article 16 of Regulation (EEC) No 2537/72 the words 'No refund or compensatory amount' are replaced by the words ' No refund or compensatory Article 2 amount, including the compensatory amounts provided for in the Act annexed to the Accession Treaty.' (a) In Article 8 of Regulation (EEC) No 1282/72, and
(b) in Article 9 of Regulation EEC No 1717/72, Article 6 the words 'The compensatory amounts provided for in Regulation (EEC) No 974/71 ' are replaced Article 14 of Regulation (EEC) No 2561/72 is amended by the words 'The compensatory amounts pro as follows : vided for in Regulation (EEC) No 974/71 and the compensatory amounts provided for in the Act (a) the present provisions become paragraph 1 ; annexed to the Accession Treaty.' (b) the following paragraph is added :
'2. The compensatory amounts provided for in Article 3 the Act annexed to the Accession Treaty shall not be applicable to concentrated butter sold pursuant Article 27 of Regulation (EEC) No 1519/72 is replaced to this Regulation.' by the following :
'Article 27 Article 7 As regards butter and butter processed into the products referred to in Article 19 : This Regulation shall enter into force on the day of (a) the compensatory amounts fixed pursuant to its publication in the Official Journal of the European Communities . Regulation (EEC) No 974/71 shall be multiplied by the coefficient 0-2 : the Commission may, if necessary, alter this coefficient ; This Regulation shall apply from 1 February 1973 .
This Regulation shall be binding in its entirety and directly applicable in all Member States .
