REGULATION ( EEC) No 1135/74 OF THE COUNCIL of 29 April 1974

fixing the derived intervention prices and the reference qualities for baled tobacco from the 1974 harvest

THE COUNCIL OF THE EUROPEAN Whereas, to this end, it is necessary to define the COMMUNITIES , reference qualities so that as objective an assessment as possible can be made of the quality of the baled tobacco ; whereas the corresponding reference qual­ ities of leaf tobacco set out in Council Regulation Having regard to the Treaty establishing the Euro­ (EEC) No 1134/74 (3 ) of 29 April 1974 fixing the pean Economic Community ; norm price, the intervention price and the reference qualities for leaf tobacco from the 1974 harvest, should be retained, with such adjustments as necess­ Having regard to Council Regulation (EEC ) No 727/ ary to take account of the characteristics peculiar 70 0 ) of 21 April 1970 on the common organization to baled tobacco ; whereas the baled tobacco corres­ of the market in raw tobacco, as last amended by the ponding to the reference qualities thus determined Act of Accession (2), and in particular Article 6 ( 8 ) can be considered as representative of the average thereof ; quality of baled tobacco obtained by the first processing and market preparation of leaf tobacco of the corresponding reference quality; Having regard to the proposal from the Commission ;

Having regard to the Opinion of the European Whereas Article 6 (2) of Regulation (EEC) No 727/70 Parliament; provides that, for a stated variety, the derived inter­ vention price shall be equal to the intervention price fixed in accordance with the provisions of Article 2 Whereas so far as baled tobacco which has been of the said Regulation for leaf tobacco of the same obtained from Community-grown leaf tobacco and variety, plus the cost of first processing and market which has undergone first processing and market preparation of Community leaf tobacco as baled preparation is concerned, derived intervention prices tobacco ; whereas the flat-rate assessment of this cost, may be fixed each year for the harvest of the follow­ made when derived . intervention prices were last ing calendar year; fixed should be adjusted to take account of the average increase in earnings in the Community, Whereas it is desirable to fix, in respect of the 1974 harvest, derived intervention prices both for the varieties which before the common organization of the market came into force were subject to a price guarantee at the baled tobacco stage, and for the HAS ADOPTED THIS REGULATION : varieties which are principally grown in Germany, in order to take account of marketing practices in that country ;

Article 2 for baled tobacco referred to in Article 6 of Regu­ lation ( EEC ) No 727/70 are set out in Annex II . For the 1974 harvest the derived intervention prices

This Regulation shall be binding in its entirety and directly applicable in all Member States .
