concerning transitional measures for the granting by Italy of national aids in the sugar sector

THE COMMISSION OF THE EUROPEAN marketing year ; whereas those undertakings are there­ COMMUNITIES, fore not eligible to benefit either under the present or under the future regime of national aid ; Having regard to the Treaty establishing the European Economic Community ; Whereas in view of the deficit supply situation in Italy it is desirable in respect of the quantities in question Having regard to Council Regulation (EEC) No to provide as a transitional measure that Italy may 3330/74 (') of 19 December 1974 on the common grant national aid as provided for under the regime organization of the market in sugar, and in particular now in force ; Article 43 thereof ; Whereas the measures provided for in this Regulation Whereas Article 34 of Council Regulation No 1009/ are in accordance with the Opinion of the Manage­ 67/ EEC (2) of 18 December 1967 on the common ment Committee for Sugar, organization of the market in sugar, as last amended by Regulation (EEC) No 2476/74 (3), authorizes Italy up to 30 June 1975 to grant adaptation aids to its beet HAS ADOPTED THIS REGULATION : producers and its beet processing industry in respect of quantities of white sugar not exceeding the basic Article 1 quota of each undertaking and in respect of the quan­ tity of beet used for the production of that sugar ; Italy is hereby authorized to grant the national aid whereas Article 38 of Regulation ( EEC) No 3330 /74 provided for under Article 34 of Regulation No 1009 / introduces with effect from 1 July 1975 a new regime 67/ EEC in respect of any quantity of white sugar for the granting by Italy of such aid and provides in produced by an undertaking during the 1974/75 particular for the granting of aid in respect of a quan­ marketing year in excess of its basic quota and in tity of white sugar not exceeding the basic quantity respect of the beet used for the production of that allocated to Italy in respect of the beet used in the sugar. manufacture of that sugar ;

Whereas during the 1974/ 75 sugar marketing year Article 2 certain undertakings have produced a quantity of sugar exceeding the basic quota ; whereas Article 32 of This Regulation shall enter into force on the third day Regulation No 1009/ 67/ EEC prescribes that no following it§. publication in the Official Journal of production can be carried forward to the 1975/76 the European Communities.

This Regulation shall be binding in its entirety and directly applicable in all Member States .
