fixing the monetary compensatory amounts and certain rates for their application
THE COMMISSION OF THE EUROPEAN account and that currency, paragraph 1 as above is to COMMUNITIES, apply mutatis mutandis where, for the currency in question, the average spot market rate during a period to be determined differs by 1 % or more from Having regard to the Treaty establishing the the exchange rate used; European Economic Community ;
Whereas in the present situation these conditions are fulfilled for all Community currencies ; whereas for Having regard to Council Regulation (EEC) No Denmark under this method of calculation no 974/71 (*) of 12 May 1971 on certain measures of monetary compensatory amount is required ; conjunctural policy to be taken in agriculture following the temporary widening of the margins of Whereas, under Article 2 ( 1 ) ( a) of the said fluctuation for the currencies of certain Member Regulation, for products covered by intervention States, as last amended by Regulation (EEC) No arrangements the monetary compensatory amounts 475/75 (2), and in particular Article 6 thereof; for the Member States which keep their exchange rates at any given moment within a maximum spread of 2-25 % are to be equal to the amounts obtained by Whereas Article 1 ( 1 ) of Regulation (EEC) No 974/71 applying to the price, the percentage difference provides that any Member State which for the between : purposes of commercial transactions allows the exchange rate of its currency to fluctuate by a margin — the conversion rate used for purposes of the wider than that permitted by the international rules common agricultural policy, and in force on 12 May 1971 shall, in the case of products as referred to in paragraph 2 of that Article — the conversion rate resulting from the central and in respect of trade with other Member States and rate ; with third countries : Whereas the monetary compensatory amounts for (a) where its currency has appreciated by more than Germany and the Benelux countries should accordingly the margin of fluctuation, levy compensatory be calculated by applying 10 and 2 % respectively; amounts on imports and grant compensatory whereas those amounts should remain unchanged for amounts on exports ; as long as the items used in calculating them do not

Whereas, for other products whose price depends on the price of the products as aforesaid and which are Whereas the monetary compensatory amounts governed by the common organization of markets, or provided for in Regulation (EEC) No 974/71 were are the subject of a specific arrangement under fixed by Regulation (EEC) No 539/75 (8) which has Article 235 of the Treaty, the said Article 2 provides since been amended serveral times ; whereas therefore that the monetary compensatory amounts are to be it is advisable to replace Regulation (EEC) No 539/75 equal to the amount by which prices of the product by a new Regulation; concerned are affected as a result of the effect on the prices of the products on which they are dependent Whereas the measures provided for in this Regulation of such compensatory amount; are in accordance whith the Opinions of the Management Committees for Wine, Cereals, Pigmeat, Whereas account must be taken of the new Poultrymeat and Eggs, Sugar, Milk and Milk Products, and Beef and Veal , representative rates applicable from 4 August 1975 which were fixed by Council Regulation (EEC) No 475/75 of 27 February 1975 as amended by
Regulation (EEC) No 1925 /75 (*).
HAS ADOPTED THIS REGULATION : Whereas by Regulation (EEC) No 1380/75 (2) of 29 May 1975 , the Commission laid down detailed rules for the application of Regulation (EEC) No Article 1 974/71 ; whereas under Article 4 of that Regulation a monetary compensatory amount is to be fixed for The monetary compensatory amounts provided for in each Member State and each product that meets the Article 1 of Regulation (EEC) No 974/71 shall for conditions laid down in Article 1 of Regulation each Member State be as shown in Annex I hereto. (EEC) No 974/71 ; whereas that amount is to apply in respect of trade between Member States and with non-member countries ; whereas, however, Article 2
(a ) in trade with the new Member States, accession compensatory amounts and the fixed The coefficients provided for in Article 4 (3) of components provided for in Article 61 of the Act Regulation (EEC) No 1380/75 shall be as shown in of Accession and, Annex II hereto.
(b ) in trade with the non-member countries, import charges, export refunds and export levies , as Article 3 expressed in units of account
Regulation (EEC) No 539/75 is hereby repealed. are to be multiplied by a coefficient derived from the percentage used in calculating the monetary
compensatory amounts ; Article 4
Whereas Article 9 of Regulation (EEC ) No 1380/75 This Regulation shall enter into force on 4 August provides that no compensatory amounts are to apply 1975 .

This Regulation shall be binding in its entirety and directly applicable in all Member States .

(*) For products under subheading 04.01 A II a), the basic amount as well as the additional amount is replaced by the single amount of 0.725.
H When a product is denaturalized, according to Article 2 of Regulation (EEC) No 990/72, the basic amount and the possible supplementary amount shall be replaced by a single amount of: 18.68 DM per 100 kg for Germany, 70.0 Bfrs/ Lfrs per 100 kg for Belgium and Luxembourg, 4-82 Fl per 100 kg for the Netherlands, 2.409 £ per 100 kg for the United Kingdom, — 0.886 £ per 100 kg for Ireland.
O The basic amount for 100 kg of product under this subheading is equal to the sum of the following elements :
(a) the amount per kg indicated multiplied by the weight of milk and cream contained in 100 kg of the product ;
(b) an additional amount for each percentage of saccharose content in 100 kg net of the product, equal to : 0.1090 DM for Germany, 0*3020 Bfrs/Lfrs for Belgium and Luxembourg, 0.0208 Fl for the Netherlands, 0-0141 £ for the United Kingdom, 0.0052 £ for Ireland .
3) The basic amount for 100 kg of product under this subheading is equal to the sum of the following elements :
(a) the amount per 100 kg indicated ;
( b) an additional amount for each percentage of saccharose content in 100 kg net of the pro duct, equal to : — 0.1090 DM for Germany, — 0.3020 Bfrs/Lfrs for Belgium and Luxembourg, — 0.0208 Fl for the Netherlands, — 0.0141 £ for the United Kingdom, — 0-0052 £ for Ireland .
4) However, for butter for which measures are taken :
— according to Regulations (EEC) No 1259/72 (OJ No L 139, 17. 6. 1972) and .(EEC) No 232/75 ( OJ No L 24, 31 . 1 . 1975), this amount is affected by the coefficient 0.5 ; however, for the United Kingdom this coefficient is 0-8,
— according to Regulation (EEC) No 349/73 (OJ No L 40, 13 . 2. 1973) this amount is affected by the coefficient 0-4,
— according to Regulations (EEC) No 1282/72 ( OJ No L 142, 22. 6. 1972), (EEC) No 1717/72 (OJ No L 181 , 9. 8 . 1972), as well as to Regulations concerning the supply of food aid, this amount is affected by the coefficient 0.
5) In trade with third countries this amount is affected by the coefficient 1.6992.
6) For importations from New Zealand in accordance with the provisions of Protocol No 18 this compensatory amount is fixed at 4.190 and the special levy is not affected by the coefficient.
7) For importations from New Zealand in accordance with the provisions of Protocol No 18 this compensatory amount is fixed at 3.618 and the special levy is not affected by the coefficient.
For the calculation of the fat content, only milk fat is taken into consideration.
