changing the monetary compensatory amounts following changes in exchange rates for the Italian lira

THE COMMISSION OF THE EUROPEAN whereas notwithstanding Article 3 of Commission COMMUNITIES, Regulation (EEC) No 1380/75 of 29 May 1975 laying down detailed rules for the application of monetary compensatory amounts (6), as last amended by Having regard to the Treaty establishing the Regulation (EEC) No 2819/75 (6), the spot market European Economic Community, rates for the Italian lira against each of the currencies of these Member States which keep their exchange rates within a spread at any given moment of 2-25 % Having regard to Council Regulation (EEC) No should be calculated from quotations for the Italian 974/71 of 12 May 1971 on certain measures of lira recorded on the exchanges in these Member conjunctural policy to be taken in agriculture States ; following the temporary widening of the margins of fluctuation for the currencies of certain Member States (*), as last amended by Regulation (EEC) No Whereas this -method of determining the lira rate 475/75 (2), and in particular Article 6 thereof, should be used until official average rates are once again available on the Rome and Milan exchanges; Whereas the monetary compensatory amounts / introduced by Regulation (EEC) No 974/71 were Whereas in view of the lack of official quotations and fixed by Commission Regulation (EEC) No 2719/75 of the uncertainty as to future trends in the Italian of 24 October 1975 (8), as last amended by economy in general and as to the trend of the lira in Regulation (EEC) No 171/76 (4); whereas this particular, the greatest caution should be shown; Regulation does not provide for monetary compensatory amounts for Italy;

Whereas the present situation on the wine market is Rome and Milan foreign exchange markets are once such that monetary compensatory amounts should be again available, the spot market rates for the Italian established for a period of about one month only ; lira against each of the currencies of the Member States which keep their exchange rates within a Whereas the measures provided for in this Regulation spread at any given moment of 2-25 % shall be the are in accordance with the opinion of the relevant mean of the average rates fixed each working day on Management Committees, the foreign exchange markets of these Member States .

HAS ADOPTED THIS REGULATION : Article 3

Article 1 In respect of wine, monetary compensatory amounts shall apply in Italy only until 29 February 1976.

1 . The 'Italia' columns in Annex I to this Regulation shall be added in Annex I to Regulation Article 4 (EEC) No 2719/75 .

2. Annex II to Regulation (EEC) No 2719/75 shall 1 . This Regulation shall enter into force on 9 February 1976. be replaced by Annex II to this Regulation.

2. During the period up to 22 February 1976, the Article 2 Italian monetary compensatory amounts shall be changed only if the difference referred to in Article 2 Notwithstanding Article 3 of Regulation (EEC) No ( 1 ) of Regulation (EEC) No 974/71 is at least one 1380/75 , until sucih time as official average rates fixed point lower than the percentage taken as a basis for each working day during official dealings on the the preceding determination .

This Regulation shall be binding in its entirety and directly applicable in all Member States .

(') Le montant compensatoire n'est pas perçu dans la limite d un contingent tarifaire annuel à octroyer par les autorités compétentes des Commu­ nautés européennes : a) pour les génisses et vaches, autres que celles destinées à la boucherie, de la race grise, brune, jaune tacheté du Simmental et du Pinzgau ; b) pour des taureaux, vaches et génisses autres que ceux destinés à la boucherie, de la race tachetée du Simmental, de la race de Schwyz et de la race de Fribourg. f1) The compensatory amount will not be levied on animals imported within an annual tariff quota to be granted by the competent authorities of the European Communities : (a) for heifers and cows, other than those intended for slaughter, of the grey, brown, and mottled yellow Simmental and Pinzgau breeds, (b) for bulls, heifers, and cows, other than those intended for slaughter, of the mottled Simmental breed, the Schwyz breed, and the Friborg breed. (') Der Ausgleichsbetrag wird nicht erhoben im Rahmen eines von den zuständigen Stellen der Europäischen Gemeinschaften zu gewährenden jährlichen Zollkontingents : a) für Färsen und Kühe, nicht zum Schlachten , der Rassen Grauvieh, Braunvieh, Gelbvieh, Fleckvieh (Simmentaler) und Pinzgauer, b) für Stiere, Kühe und Färsen der Schwyzer, Simmentaler (Fleckvieh) oder Freiburger Rasse, nicht zum Schlachten.
