adapting the volume and allocation of certain quantitative import quotas for certain textile products originating in Taiwan
THE COMMISSION OF THE EUROPEAN Member States before the said quotas were opened, COMMUNITIES, Member States should be authorized to charge the quantities imported in excess of the quotas and quota shares for 1975 against those for 1976, when such Having regard to Council Regulation (EEC) No excess quantities have exceded the limit of 10 % fixed 1023/70 of 25 May 1970 establishing a common proce by Article 3 ( 1 ) of Regulation (EEC) No 1783/75 and dure for administering quantitative quotas ( !), and in Article 2 of Regulation (EEC) No 1849/75 ; particular Article 2 thereof,
Whereas the measures provided for in this Regulation Having regard to Council Regulation (EEC) No are in accordance with the opinion of the Quota Administration Committee, 1783/75 of 10 July 1975 on rules for imports of certain textile products originating in Taiwan (2), and in particular Articles 1 and 3 thereof,
Whereas it is necessary to correct the description of HAS ADOPTED THIS REGULATION : certain goods contained in the Annex to Commission Regulation (EEC) No 1849/75 of 18 July 1975 allo cating quantitative quotas in respect of imports into the Community of certain textile products originating Article 1 in Taiwan (3), and also certain of the amounts indi cated in the said Annex ; The Annex to the abovementioned Commission Regu lation (EEC) No 1849/75 is hereby replaced, as Whereas the quantitative quotas fixed by Articles 1 regards the quota shares for 1976 and 1977, by the and 2 of Regulation (EEC) No 1783/75 were opened Annex to this Regulation. only during the year ; whereas their volume was consequently reduced, as provided for in that Regula tion, by the volume of the imports effected prior to Article 2 the opening of the quotas concerned ;
1 . Where imports of products covered by Council Whereas after being thus reduced certain of these Regulation (EEC) No 1783/75 effected during 1975 quotas and of the quota shares fixed for the Member exceeded the volumes indicated for that year in States by Regulation (EEC) No 1849/75 proved to be Annex II to that Regulation or the quota shares indi inadequate in view of the volume of the contracts cated for the same year in the Annex to Commission concluded before the Community system came into Regulation (EEC) No 1849/75, the excess quantities force ; shall be charged, within the limit of 10 % provided for in the said Regulations, against the corresponding quotas or quota shares for 1976. Whereas under these circumstances, in accordance with the opinion delivered by the Quota Administra tion Committee, imports should be abolished in 2. Member States shall be authorized to charge the excess of the limits established for the year 1975 by total volume of the excess quantities referred to in the said Regulations (EEC) No 1783/75 and (EEC) No paragraph 1 against the corresponding quotas or quota 1849/75 ; shares for 1976 .

This Regulation shall be binding in its entirety and directly applicable in all Member States .
