altering the monetary compensatory amounts

THE COMMISSION OF THE EUROPEAN Whereas detailed rules for the application of monetary COMMUNITIES, compensatory amounts were laid down by Regulation ( EEC) No 1380/75 of 29 May 1975 (5), as last Having regard to the Treaty establishing the European amended by Regulation (EEC) No 1834/76 (6); Economic Community, whereas the spot market rates recorded for the pound sterling, the Irish pound, the French franc and the Italian lira pursuant to Regulation (EEC) No 1380/75 Having regard to Council Regulation (EEC) No during the period 6 to 12 October 1976 show that the 974/71 of 12 May 1971 on certain measures of difference has changed by more than one point from conjunctural policy to be taken in agriculture following the temporary widening of the margins of the percentage taken as a basis when the monetary fluctuation for the currencies of certain Member compensatory amounts were last fixed,

States t 1 ), as last amended by Regulation (EEC) No 557/76 (2 ), and in particular Article 3 , HAS ADOPTED THIS REGULATION :

Whereas the monetary compensatory amounts Article 1 provided for in Regulation ( EEC) No 974/71 were fixed by Commission Regulation (EEC) No 572/76 of 1 . In Annex I to Regulation (EEC) No 572/76 the 15 March 1976 (3), as last amended by Regulation columns headed 'United Kingdom', 'Ireland', 'Italia' ( EEC ) No 2466/76 (4 ); and 'France' are hereby replaced by those set out in Annex I to this Regulation.

Whereas, under Article 3 of Regulation (EEC) No 2. Annexes II and III to Regulation (EEC) No 974/71 , the monetary compensatory amounts must be 572/76 are hereby replaced by Annexes II and III to altered if the difference referred to in Article 2 ( 1 ) of this Regulation. that Regulation changes by one point or more from the percentage taken as a basis for the preceding Article 2 determination ; whereas the compensatory amounts must be altered in accordance with the change in this This Regulation shall enter into force on 18 October difference ; 1976 .

C) Pour les produits relevant de la sous-position 23.07 B I c) 1 ou 2 du tarif douanier commun, d'une teneur en poids supérieure à 50% de produits relevant de la position 07.06 ou 11.06 du tarif douanier commun , les montants compensatoires monétaires sont applicables aux produits relevant de la sous position 07.06 A du tarif douanier commun (Règlement (CEE) n0 1497/76, JO n0 L 167 du 26. 6. 1976, p . 27).

4) For products under subheading 04.01 A II a) the basic amount as well as the additional amount is replaced by the single amount of 3-680.

5) The basic amount for 100 kg of product under this subheading is equal to the sum of the following elements : ( a) the amount per 100 kg indicated ; (b) an additional amount for each percentage of saccharose content in 100 kg net of the product, equal to : — 0-0704 £ for the United Kingdom, — 0-0474 £ for Ireland, — 40-21 Lit for Italy, — 0-256 FF for France.

8) However, for butter which is the subject of the measures provided for: — in Regulations (EEC) No 1282/72 ( OJ No L 142, 22. 6. 1972) and (EEC) No 1717/72 ( OJ No L 181 , 9. 8 . 1972), this amount shall be multiplied by the coefficient 0-4 ; however, in the case of the United Kingdom the coefficient shall be 0-6; — in Regulation (EEC) No 349/73 ( OJ No L 40, 13 . 2. 1973 ), this amount shall be multiplied by the coefficient 0-5 ; — in Regulation (EEC) No 232/75 ( OJ No L 24, 31 . 1 . 1975 ) this amount shall be multiplied by the coefficient 0-35 ; however, in the case of the United Kingdom this coefficient is 0-40.*

( 7) For importations from New Zealand in accordance with the provisions of Protocol No 18 this compensatory amount is fixed at 22-768 and the special levy is not affected by the coefficient.

8) For importations from New Zealand in accordance with the provisions of Protocol No 18 this compensatory amount is fixed at 19-657 and the special levy is not affected by the coefficient.

9) In trade with third countries the coefficient 1-7120 is applied to this amount. This coefficient, however, shall be 1-5579 in the case of products containing skimmed-milk powder sold under Regulation (EEC) No 2054/76. For products consigned to Italy by another Member State in accordance with Regulation (EEC ) No 1624/76 ( OJ No L 180, 6 . 7. 1976) this amount shall be multiplied by the coeffient 0-58 .
