fixing the free-at-frontier reference prices applicable to wine imports from 16
December 1976
THE COMMISSION OF THE EUROPEAN should be laid down so that the system introduced by
COMMUNITIES, Regulation (EEC) No 2506/75 can be applied without
too much difficulty once it enters into force in the Having regard to the Treaty establishing the European new Member States ; Economic Community,

Whereas Regulation (EEC) No 2506/75 lays down 1 . The free-at-frontier reference prices referred to
special rules relating to the importation of certain in Article 5 (2) of Regulation (EEC) No 2506/75 shall
products in the wine-growing sector ; whereas Commi be, for wines imported into the Community as origi
sion Regulation (EEC) No 1 393/76 of 17 June nally constituted, as indicated in the Annex hereto.
1976 (3) lays down detailed rules to this end ; whereas 2. The free-at-frontier reference prices for imports in accordance with Article 5 (2) of Regulation (EEC) into the new Member States, to be determined in No 2506/75 the Commission fixes the free-at-frontier accordance with the criteria applied in the Annex, reference prices ; shall be equal, for each import, to the reference price
Whereas the list of free-at-frontier reference prices less :
should be established taking into account trade — in the case of wines originating in third countries requirements in particular and with a view to adminis granted preferential tariff concessions, the customs trative simplicity ; duties actually applied in accordance with the rele
Whereas Article 1 of Regulation (EEC) No 2506/75 vant agreements ;
provides that the free-at-frontier reference prices are — in the case of other wines, the customs duties actu
to be equal to the reference price less customs duties ally applied in accordance with Article 59 (2) of
actually levied ; whereas it is necessary to specify that the Act of Accession .

tary compensatory amounts must not be taken into Article 2
account in assessing the customs duty to be deducted Regulation (EEC) No 1403/76 (4) is hereby repealed. from the reference price ;
Whereas the new Member States continue to apply Article 3
specific customs duties until 1 July 1977 ; whereas, This Regulation shall enter into force on the third day therefore, until that date these States will apply following its publication in the Official Journal of different free-at-frontier prices from those applicable the European Communities. in the other Member States ; whereas in view of this
special situation the necessary transitional provisions It shall apply with effect from 16 December 1976.
This Regulation shall be binding in its entirety and directly applicable in all Member
States .
