altering the monetary compensatory amounts

THE COMMISSION OF THE EUROPEAN changed by more than one point from the percentage COMMUNITIES , taken as a basis when the monetary compensatory amounts were last fixed ; Having regard to the Treaty establishing the European Economic Community, Whereas Council Regulation (EEC ) No 557/76 of 15 March 1976 on the exchange rates to be applied in Having regard to Council Regulation (EEC ) No agriculture, as last amended by Regulation (EEC ) No 974/71 of 12 May 1971 on certain measures of 3206/76 (7 ), fixed a new representative rate for the conjunctural policy to be taken in agriculture Irish pound in principle with effect from 17 January following the temporary widening of the margins of 1977; whereas this rate and its entry into force fluctuation for the currencies of certain Member should be taken into account when fixing the States (*), as last amended by Regulation (EEC) No monetary compensatory amounts ; 557/76 (2 ), and in particular Articles 3 and 6 thereof, Whereas, as regards the consequences for the Irish Whereas the monetary compensatory amounts pound of the change in the representative rate, the provided for in Regulation ( EEC) No 974/71 were management committees concerned have been fixed by Commission Regulation (EEC ) No 572/76 of consulted ; whereas, in this connection, the measures 15 March 1976 (3 ), as last amended by Regulation provided for in this Regulation are in accordance ( EEC ) No 25 /77 ( 4 ); with the opinion of those management committees,

Whereas, under Article 3 of Regulation ( EEC) No HAS ADOPTED THIS REGULATION : 974/71 , the monetary compensatory amounts must be altered if the difference referred to in Article 2 ( 1 ) of Article 1 that Regulation changes by one point or more from the percentage taken as a basis for the preceding 1 . In Annex I to Regulation ( EEC ) No 572/76 the determination ; whereas the compensatory amounts columns headed 'United Kingdom', ' Ireland', 'Italia' must be altered in accordance with the change in this are hereby replaced by those set out in Annex I to difference ; this Regulation .

Whereas detailed rules for the application of 2. Annexes II and III to Regulation ( EEC ) No monetary compensatory amounts were laid down by 572/76 are hereby replaced by Annexes II and III to Regulation (EEC) No 1380/75 of 29 May 1975 (5), as this Regulation . last amended by Regulation ( EEC) No 1834/76 ( 6); whereas the spot market rates recorded for the Article 2 English pound and the Italian lira pursuant to Regulation (EEC) No 1380/75 during the period 5 to This Regulation shall enter into force on 17 January 11 January 1977 show that the difference has 1977 .

This Regulation shall be binding in its entirety and directly applicable in all Member States .

Tuttavia, nel caso in cui detti prodotti contengano latte scremato in polvere e sia a) farina di pesce o olio di pesce e/o di fegato di pesce, b) carbone attivo e/o una miscela di giallo tartrazina (E 102) e blu patente V (E 131) o di rosso cocciniglia A (E 124) o blu patente V (E 131 ), c) carbonato di ferro e/o solfato di ferro e/o solfato di rame, l'importo compensativo, da applicare negli scambi intracomunitari e con i paesi terzi, è rispettivamente : — per la sottovoce 23.07 B I a) 2 quello della sottovoce 23.07 B I a) 1 , — per la sottovoce 23.07 B I b) 2 quello della sottovoce 23.07 B I b) 1 , — per la sottovoce 23.07 B I c) 2 quello della sottovoce 23.07 B I c) 1 .

Wanneer evenwel deze produkten magere-melkpoeder bevatten en a) vismeel of visolie en/of visleverolie, b) actieve kool en/of een mengsel van tartrazinegeel (E 102) en patentblauw V (E 131) of cochenille-rood A (E 124) of patentblauw V (E 131 ), c) ijzercarbonaat en/of ijzersulfaat en/of kopersulfaat wordt het in het intra-communautaire handelsverkeer en het handelsverkeer met derde landen toe te passen compenserende bedrag voor respectievelijk — onderverdeling 23.07 B I a) 2 dat van onderverdeling 23.07 B I a) 1 , — onderverdeling 23.07 B I b) 2 dat van onderverdeling 23.07 B I b) 1 , — onderverdeling 23.07 B I c) 2 dat van onderverdeling 23.07 B I c) 1 . Dog, når disse produkter indeholder skummetmælkspulver og enten a) fiskemel eller fiskeolie og/eller fiskelevertran, b) aktivt kul og/eller en blanding af tartrazingult (E 102) og patent blue V (E 131) eller cochenillerødt A (E 124) eller patentblue V (E 131 ), c) jerncarbonat og/eller jernsulfat og/eller kobbersulfat, anvendes det monetære udligningsbeløb til veksling inden for Fællesskabet og med tredjelande, henholdsvis — for underposition 23.07 B I a) 2 i stedet for underposition 23.07 B I a) 1 , — for underposition 23.07 B I b) 2 i stedet for underposition 23.07 B I b) 1 , — for underposition 23.07 B I c) 2 i stedet for underposition 23.07 B I c) 1 .

7) Pour les produits relevant de la sous-position 23.07 B I c) 1 ou 2 du tarif douanier commun, d'une teneur en poids supérieure à 50% de produits relevant de la position 07.06 ou 11.06 du tarif douanier commun , les montants compensatoires monétaires sont applicables aux produits relevant de la sousposition 07.06 A du tarif douanier commun (règlement (CEE) n° 1497/76, JO n° L 167 du 26. 6. 1976, p. 27) .
