altering the monetary compensatory amounts

THE COMMISSION OF THE EUROPEAN whereas the spot market rate recorded for the pound COMMUNITIES , sterling and the Italian lira pursuant to Regulation (EEC ) No 1380/75 during the period 10 to 16 August Having regard to the Treaty establishing the 1977 shows that the difference has changed by more European Economic Community, than one point from the percentage taken as a basis when the monetary compensatory amounts were last Having regard to Council Regulation (EEC) No fixed ; 974/71 of 12 May 1971 on certain measures of conjunctural policy to be taken in agriculture Whereas pursuant to Article 5 of Regulation (EEC) following the temporary widening of the margins of No 1380/ 75 , where the condition laid down in fluctuation for the currencies of certain Member Article 3 of Regulation (EEC ) No 974/71 is met States (*), as last amended by Regulation (EEC) No only in respect of the Irish pound or the pound 557/76 (2), and in particular Article 3 thereof, sterling, the monetary compensatory amounts ap­ plicable in the two Member States concerned must Whereas the monetary compensatory amounts be altered by reference to the changes recorded for provided for in Regulation (EEC) No 974/71 were each of the two currencies, fixed by Commission Regulation (EEC) No 938/77 of 29 April 1977 (3), as last amended by Regulation HAS ADOPTED THIS REGULATION : ( EEC ) No 1852/77 (4 ); Article 1 Whereas, under Article 3 of Regulation (EEC) No 974/71 , the monetary compensatory amounts must be 1 . Toutefois , dans le cas visé ci-dessus, le montant compensatoire applicable jusqu au 2 octobre 1977 dans les échanges intracommunautaire* et avec les pays tiers est respectivement : — pour la sous-position 23.07 B I a ) 2 celui de la sous-position 23.07 B I a ) 1 , — pour la sous-position 23.07 B I b) 2 celui de la sous-position 23.07 B I b) 1 , — pour la sous-position 23.07 B I c) 2 celui ce la sous-position 23.07 B I c) 1 .

However, in the case referred to above, the monetary compensatory amounts applicable to intra-Community trade and to trade with third countries until 2 October 1977 shall be : — for subheading 23.07 B I a ) 2 that for subheading 23.07 B I a ) 1 , — for subheading 23.07 B I b) 2 that for subheading 23.07 B I b ) 1 , — for subheading 23.07 B I c ) 2 that for subheading 23.07 B 1 c ) 1 .

In dem vorgenannten Fall wird jedoch bis zum 2 . Oktober 1977 im innergememschaftlichen Handel und im Handel mit Drittländern — für die Tarifstelle 23.07 B I a ) 2 der "Währungsausgleichsbetrag der Tarifstelle 23.07 B I a) 1 , — für die Tarifstelle 23.07 B I b) 2 der Währungsausgleichsbetrag der Tarifstelle 23.07 B I b) 1 und —■ für die Tarifstelle 23.07 B I c) 2 der Währungsausgleichsbetrag der Tarifstelle 23.07 B 1 c) 1 angewandt .

Tuttavia nel caso di cui sopra , l'importo compensativo applicabile fino al 2 ottobre 1977 negli scambi intracomunitari e con i paesi terzi è rispettivamente : — per la sottovoce 23.07 B I a) 2 quello della sottovoce 23.07 Bla ) 1 , — per la sottovoce 23.07 B I b ) 2 quello della sottovoce 23.07 B I b) 1 , — per la sottovoce 23.07 B 1 c) 2 quello della sottovoce 23.07 B I c) 1 .

Evenwel wordt in het hieronderbedoelde geval het tot en met 2 oktober 1977 toe te passen compenserende bedrag in het intracommu­ nautaire handelsverkeer en in het handelsverkeer met derde landen respectievelijk : — voor onderverdeling 23.07 B I a ) 2 dat van onderverdeling 23.07 B I a) 1 , — voor onderverdeling 23.07 B I b) 2 dat van onderverdeling 23.07 Bib ) 1 , — voor onderverdeling 23.07 B I c) 2 dat van onderverdeling 23.07 Bic ) 1 .

Dog er det monetære udligningsbeløb, der er henvist til i ovennævnte tekst, og som anvendes indtil den 2 . oktober 1977 for handel indenfor Fællesskabet og for handel med tredjelande henholdsvis : — for underposition 23.07 B I a) 2 , det der gælder for underpos . 23.07 B I a) 1 — for underposition 23.07 B I b) 2 , det der gælder for underpos . 23.07 B I b) 1 — for underposition 23.07 B I c) 2 , det der gælder for underpos . 23.07 B I c) 1 .

(2 ) In intra-Community trade, and when the product is denaturalized, according to Article 2 of Regulation (EEC) No 990/72, the basic amount and the possible supplementary amount shall be replaced by a single amount of: — 11-234 £ per 100 kg for the United Kingdom , — 1-752 £ per 100 kg for Ireland , — 8 568 Lit per 100 kg for Italy .

3) The basic amount for 100 kg of product under this subheading is equal to the sum of the following elements : ( a) the amount per 100 kg indicated multiplied by 1/100 of the weight of milk and cream contained in 100 kg of the product; (b) an additional amount for each percentage of saccharose content in 100 kg net of the product, equal to 1/100 of the amount indicated in Part 7 of Annex I to this Regulation under subheading 17.01 A ( undenatured) of the Common Customs Tariff.

(4 ) For products under subheading 04.01 A II a) the basic amount as well as the additional amount is replaced by the single amount of 3-597.

(5 ) The basic amount for 100 kg of product under this subheading is equal to the sum of the following elements : ( a) the amount per 100 kg indicated ; (b) an additional amount for each percentage of saccharose content in 100 kg net of the product, equal to 1/100 of the amount indicated in Part 7 of Annex I to this Regulation under subheading 17.01 A ( undenatured ) of the Common Customs Tariff.

6) However, for butter which is the subject of the measures provided for : — in Regulation ( EEC) No 1282/72 ( OJ No L 142, 22 . 6. 1972), this amount shall be multiplied by the coefficient 0-42 ; however, in the case of the United Kingdom the coefficient shall be 0-47; — in Regulation (EEC ) No 1717/72 ( OJ No L 181 , 9 . 8 . 1972 ), this amount shall be multiplied by the coefficient 0-40 ; however, in the case of the United Kingdom the coefficient shall be 0-45 ; — in Regulation (EEC) No 349/73 ( OJ No L 40, 13 . 2 . 1973 ), this amount shall be multiplied by the coefficient 0-47; — in Regulation (EEC) No 232/75 ( OJ No L, 24, 31 . 1 . 1975 ) this amount shall be multiplied by the coefficient 0-34 ; however, in the case of the United Kingdom the coefficient shall be 0-38 .

( 7 ) For importations from New Zealand in accordance with the provisions of Protocol 18 this compensatory amount is fixed at 21-852 and the special levy is not affected by the coefficient.

(8 ) For importations from New Zealand in accordance with the provisions of Protocol 18 this compensatory amount is fixed at 18-867 and the special levy is not affected by the coefficient.

9) In trade with third countries the coefficient 1-71 is applied to this amount. This coefficient, however, shall be 1-47 in the case of products containing skimmed-milk powder sold under Regulation ( EEC) No 2054/76. In intra-Community trade, where the product has not been produced in accordance with Regulation (EEC) No 990/72, the coefficient 1-71 is applied to this amount. However, this coefficient is not applied to the products consigned to Italy from another Member State in accordance with Regulation (EEC) No 1624/76 ( OJ No L 180, 6. 7. 1976). "When these products contain skimmed-milk powder and either fish meal or fish oil and/or liver oil or iron carbonate and/or iron sulphate and/or copper sulphate : — in the case where the contained skimmed-milk powder was sold in accordance with Regulation (EEC) No 368/77 ( OJ No L 52, 24. 2. 1977) and Regulation (EEC) No 443/77 ( OJ No L 58, 3 . 3 . 1977), the amount indicated shall be multiplied by the coefficient 0-38 ;
