THE COMMISSION OF THE EUROPEAN

COMMUNITIES,

Having regard to the Treaty establishing the European Economic Community,

Having regard to Council Regulation (EEC) No 805/68 of 27 June 1968 on the common organization of the market in beef and veal (1), as last amended by the Act of Accession of Greece, and in particular Article 6 (5) (d) thereof,

Whereas under Regulation (EEC) No 869/84 (2), the Council decided that, for a three-year experimental period, intervention measures would be applied on the basis of the Community scale for the classification of carcases of adult bovine animals established by Council Regulation (EEC) No 1208/81 (3);

Whereas Commission Regulation (EEC) No 1811/84 (4) accordingly laid down new requirements for the classification, identification and marketing of meat to be bought in by intervention agencies and amended Article 6 of Regulation (EEC) No 2226/78 (5); whereas Article 6 (2) of the that Regulation provides that the intervention agency may buy in only meat classified in accordance with the abovementioned Community scale; whereas, however, taking account of the still recent application of the scale for buying-in by the intervention agencies, and of the still limited experience of operators, provision should be made that intervention agencies should carry out a new classification at the request and expense of the party concerned in cases of erroneous classification of the meat offered;

Whereas it is necessary to correct errors in certain language versions introduced by the said Regulation (EEC) No 1811/84 in Annex II to Regulation (EEC) No 2226/78, and to amend Annex III to that Regulation;

Whereas the measures provided for in this Regulation are in accordance with the opinion of the Management Committee for Beef and Veal,

HAS ADOPTED THIS REGULATION:

Article1¶

Article 6 (2) (c) of Regulation (EEC) No 2226/78 is hereby replaced by the following:

'(c) it is classified in accordance with the Community scale provided for in Regulation (EEC) No 1208/81; the intervention agencies shall reject any products the classification of which they judge not to be in conformity with the said scale; however, at the request of the party concerned and at his expense, the intervention agency shall carry out a new classification of the product.'

Article2¶

Annex II to Regulation (EEC) No 2226/78 is hereby amended as follows:

1. In the Italian text, point 2 (a) is replaced by the following:

'a) carcasse: il corpo intero dell'animale macellato, dopo le operazioni di dissanguamento, svisceramento e scuoiamento, presentate:

- senza testa e senza zampe: la testa è separata dalla carcassa all'altezza dell'articolazione occipito-atlantoide; le zampe sono sezionate all'altezza delle articolazioni carpo-metacarpiche o tarso-metatarsiche;

- senza gli organi contenuti nelle cavità toracica e addominale, senza reni, grasso della rognonata e grasso di bacino;

- senza gli organi sessuali e muscoli aderenti, senza mammelle e il grasso mammario;

- senza diaframma né pilastro del diaframma;

- senza coda;

- senza midollo spinale;

- senza grasso scrotale;

- senza corona della fesa;

- senza vena giugulare e grasso adiacente (vena grassa);

- il collo deve essere tagliato conformemente alle prescrizioni veterinarie;

2. In the English text, the second indent of point 2 (a) is replaced by the following:

'without the organs contained in the thoracic and abdominal cavities, without the kidneys, the kidney fat or the pelvic fat,'.

3. In the German version, the second indent of point 2 (a) is replaced by the following:

'- ohne die Organe in der Brust- und Bauchhoehle, ohne Nieren, Nierenfettgewebe sowie Beckenfettgewebe,'.

4. In the Greek version, the text of Annex II is replaced by the following text:

Article4¶

221683». This Regulation shall enter into force on the third day following its publication in the Official Journal of the European Communities.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
