REGULATION (EEC) No 231 /73 OF THE COUNCIL of 31 January 1973 amending Regulations Nos 134/67/EEC and 137/67/EEC on sluice-gate prices and the system of 'pilot products and derived products' for pigmeat, with especial reference to the nomenclature of goods

THE COUNCIL OF THE EUROPEAN COMMUNITIES, Whereas the tariff nomenclature arising from Regulation No 121 /67/EEC is incorporated in the Common Customs Tariff; Having regard to the Treaty establishing the European Economic Community ;

HAS ADOPTED THIS REGULATION : Having regard to Council Regulation No 121/67/EEC (*) of 13 June 1967, on the common organization of the market in pigmeat as last Article 1 amended by the Act (2) concerning the conditions of Accession and the Adjustments to the Treaties, and in particular Articles 12 (4) and 13 (4) thereof; 1 . For the purposes of this Regulation :

Article4¶

Annex 1 of Regulation No 137/67/EEC shall be replaced by Annex 1 of this Regulation.

Article S

The Common Customs Tariff shall be amended in accordance with Annex II of this Regulation.

Article6¶

This Regulation shall enter into force on the day following its publication in the Official Journal of the European Communities.

It shall apply from 1 January 1973 in respect of heading No 15.01 of the Common Customs Tariff and from 1 February 1973 in respect of heading No 02.06 of the Common Customs Tariff.

This Regulation shall be binding in its entirety and directly applicable in all Member States .

ANNEX II

1 . Chapter 2 of the Common Customs Tariff shall be amended as follows : ( a ) The expression 'Additional Note' shall be replaced by the expression 'Additional Notes '. (b ) The existing Additional Note shall be numbered ' I '. (c) The following Additional Notes 2 and 3 shall be inserted as follows : '2. A. for the purposes of subheadings 02.06 B I a) 2 aa) and 02.06 B I b) 2 aa), "bacon side" shall be taken to mean half a pig carcase without the head, chaps, neck, feet, tail, flare fat, kidneys, tenderloin, blade bone, sternum, vertebral column, pelvic bone and diaphragm ; B. for the purposes of subheadings 02.06 B I a) 2 bb) and 02.06 B I b) 2 bb), "3 /4 sides" shall be taken to mean bacon sides without the shoulder, whether or not boned ; C. for the purposes of subheadings 02.06 B I a) 2 cc) and 02.06 B I b) 2 cc), "spencers" shall be taken to mean bacon sides without the ham, whether or not boned ; D. for the purposes of subheadings 02.06 B I a) 2 cc) and 02.06 B I b) 2 cc), "middles" shall be taken to mean bacon sides without the ham and the shoulder, whether or not boned.
