THE COMMISSION OF THE EUROPEAN (EEC ) No 1380/75 of 29 May 1975 (5 ), as last COMMUNITIES, amended by Regulation (EEC) No 1040/76 (8); whereas the spot market rates recorded for the pound sterling Having regard to the Treaty establishing the European and the Irish pound pursuant to Regulation (EEC) Economic Community, No 1380/75 during the period 26 May to 1 June 1976 show that the difference has changed by more than Having regard to Council Regulation (EEC) No one point from the percentage taken as a basis when 974/71 of 12 May 1971 on certain measures of con the monetary compensatory amounts were last fixed, junctural policy to be taken in agriculture following the temporary widening of the margins of fluctuation for the currencies of certain Member States ( 1 ), as HAS ADOPTED THIS REGULATION : last amended by Regulation (EEC) No 557/76 (2 ), and in particular Article 3 , thereof,

Whereas the monetary compensatory amounts Article 1 provided for in Regulation (EEC) No 974/71 were fixed by Commission Regulation (EEC) No 572/76 of 1 . In Parts 1 , 2, 3 , 4, 5 , 7 and 8 of Annex I to 15 March 1976 ( 3 ), as last amended by Regulation Regulation ( EEC) No 572/76 the columns headed ( EEC ) No 1258 /76 (4 ); 'United Kingdom' and 'Ireland' are hereby replaced Whereas, under Article 3 of Regulation (EEC) No by those set out in Annex I to this Regulation. 974/71 , the monetary compensatory amounts must be altered if the difference referred to in Article 2 ( 1 ) of 2 . (l) Le montant compensatoire n'est pas perçu dans la limite d'un contingent tarifaire annuel à octroyer par les autorités compétentes des Commu nautés européennes : a) pour des génisses et vaches, autres que celles destinées à la boucherie, de la race grise, brune, jaune tacheté du Simmental et du Pinzgau ; b) pour des taureaux, vaches et génisses autres que ceux destinés à la boucherie, de la race tachetée du Simmental, de la race de Schwyz et de la race de Fribourg. (') The compensatory amount will not be levied on animals imported within an annual tariff quota to be granted by the competent authorities of the European Communities : (a) for heifers and cows, other than those intended for slaughter, of the grey, brown, and mottled yellow Simmental and Pinzgau breeds, ( b) for bulls, heifers, and cows, other than those intended for slaughter, of the mottled Simmental breed, the Schwyz breed, and the Friborg breed. (') Der Ausgleichsbetrag wird nicht erhoben im Rahmen eines von den zuständigen Stellen der Europäischen Gemeinschaften zu gewährenden jährlichen Zollkontingents : a) für Färsen und Kühe, nicht zum Schlachten, der Rassen Grauvieh, Braunvieh, Gelbvieh, Fleckvieh (Simmentaler) und Pinzgauer, b) für Stiere, Kühe und Färsen der Schwyzer, Simmentaler (Fleckvieh) oder Freiburger Rasse, nicht zum Schlachten. (1 ) However for the skimmed-milk powder for which measures are taken according to Regulation (EEC) No 602/75 ( OJ No L 63 , 8 . 3 . 1975 ), this amount is affected by the coefficient 0-25 .

2) In intra-Community trade, and when the product is denaturalized, according to Article 2 of Regulation (EEC) No 990/72, the basic amount and the possible supplementary amount shall be replaced by a single amount of: — 6*209 £ per 100 kg for the United Kingdom, — 5-166 £ per 100 kg for Ireland.

3) The basic amount for 100 kg of product under this subheading is equal to the sum of the following elements : ( a) the amount per kg indicated multiplied by the weight of milk and cream contained in 100 kg of the product; (b) an additional amount for each percentage of saccharose content in 100 kg net of the product, equal to : — 0*036 £ for the United Kingdom, — 0-033 £ for Ireland .

4) For products under subheading 04.01 A II a) the basic amount as well as the additional amount is replaced by the single amount of 2*006. x

5) The basic amount for 100 kg of product under this subheading is equal to the sum of the following elements : ( a) the amount per 100 kg indicated ; (b) an additional amount for each percentage of saccharose content in 100 kg net of the product, equal to : — 0*036 £ for the United Kingdom, — 0-033 £ for Ireland .

6) However, for butter which is the subject of the measures provided for: — in Regulations (EEC) No 1282/72 ( OJ No L 142, 22 . 6. 1972) and (EEC) No 1717/72 ( OJ No L 181 , 9 . 8 . 1972), this amount shall be multiplied by the coefficient 0-4 ; however, in the case of the United Kingdom the coefficient shall be 0-6; — in Regulation (EEC) No 349/73 ( OJ No L 40, 13 . 2. 1973 ), this amount shall be multiplied by the coefficient 0-5 ; — in Regulation (EEC) No 232/75 ( OJ No L 24, 31 . 1 . 1975 ) this amount shall be multiplied by : — the coefficient 0-45 in the case of use for 'formula A' products, — the coefficient 0-65 in the case of use for 'formula B' products ; however, in the case of the United Kingdom these coefficients applied shall be respectively 0-60 and 0-85 .

7) For importations from New Zealand in accordance with the provisions of Protocol No 18 this compensatory amount is fixed at 12*757 and the special levy is not affected by the coefficient.

8) For importations from New Zealand in accordance with the provisions of Protocol No 18 this compensatory amount is fixed at 11-014 and the special levy is not affected by the coefficient.

9) In exchanges with third countries, this amount is multiplied by the coefficient 1*7285.

With effect from 1 June 1976, where these products contain skimmed-milk powder and either : ( a) fish meal or fish oil and/or liver oil, ( b ) active carbon and/or a mixture of Tartazine Yellow ( E102 ) and Patent Blue (E131 ) or Cochineal Red A ( E124) or Patent Blue V (E131 ), ( c) iron carbonate and/or iron sulphate and/or copper sulphate, (d) ground cereals and/or oil-seed cake,

no monetary compensatory amount shall be applied.

For the calculation of the fat content, only milk fat is taken into consideration.
