RÅDETS FÖRORDNING (EEG) nr 163/94 av den 24 januari 1994 om ändring av förordning (EEG) nr 386/90 om kontroll i samband med export av jordbruksprodukter som berättigar till exportbidrag eller andra belopp

EUROPEISKA GEMENSKAPERNAS RÅD HAR ANTAGIT DENNA FÖRORDNING

med beaktande av Fördraget om upprättandet av Europeiska ekonomiska gemenskapen, särskilt artikel 43 i detta,

med beaktande av kommissionens förslag(1),

med beaktande av Europaparlamentets yttrande(2), och

med beaktande av följande:

Skälen nedan är grundrättsaktens. Ändringsrättsakternas skäl: förordning (EU) nr 1234/2007.

Enligt rådets förordning (EEG) nr 386/90 av den 12 februari 1990 om kontroll i samband med export av jordbruksprodukter som berättigar till exportbidrag eller andra belopp(3), måste kommissionen för rådet framlägga en rapport om framstegen i tillämpningen av förordningen.

Det framgår klart av denna rapport och av tilläggsrapporten att den bristande smidigheten hos vissa regler kan motverka förbättringar av effektiviteten i kontrollerna; riskanalyser kan komma till bättre användning om kontrollorganen har större frihet att själva bestämma på vilka områden det särskilt skall genomföras kontroller.

Förpliktelsen att uppfylla en procentsats på 5 % per sektor och per tullkontor gör det svårare att koncentrera personella resurser på export med hög risk.

Generellt sett bör kontrollsatsen ligga kvar på 5 %, men ordningen kan göras smidigare, så att kontrollorganen kan koncentrera sina insatser på känsligare produkter.

För att minska risken för utbyte av produkter, särskilt när det gäller exportdeklarationer som framläggs och godkänns inne i medlemsstaten eller i exportörens lokaler måste det fastställas en lägsta procentsats av representativa fysiska stickprovskontroller som skall genomföras vid utförseltullkontoret.

Med tanke på nödvändigheten av att bestämmelserna om kontroll av exportbidrag tillämpas effektivt överallt i gemenskapen och mot bakgrund av de ekonomiska riskerna för gemenskapens tillgångar, måste regler antas på gemenskapsnivå.

HÄRIGENOM FÖRESKRIVS FÖLJANDE.

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty establishing the European Community, and in particular Article 43 thereof,

Having regard to the proposal from the Commission,

Having regard to the opinion of the European Parliament,

Whereas, under Council Regulation (EEC) No 386/90 of 12 February 1990 on the monitoring carried out at the time of export of agricultural products receiving refunds or other amounts, the Commission must present to the Council a report on the progress of the application of the Regulation;

Whereas it is clear from this report and from the additional report that the lack of flexibility of some of the rules could hamper improvements in the effectiveness of the checks; whereas better use could be made of risk analysis if the inspection services had greater leeway for targeting their checks;

Whereas the obligation to comply with the rate of 5 % per product per customs office makes it more difficult to concentrate human resources on high risk exports;

Whereas, while keeping the overall rate at 5 %, it is possible to introduce some flexibility so as to enable the inspection services to target their checks on more sensitive products;

Whereas, in order to mitigate the risk of substitution, particularly in the case of export declarations presented and accepted within the Member State or at the premises of the exporter, provision must be made for the imposition of a minimum rate of physical checks by means of representative sampling by the office of exit;

Whereas, in view of the need to ensure effective application, throughout the Community, of the provisions concerning checks on export refunds and given the financial risks for the Community funds, rules must be adopted at Community level,

HAS ADOPTED THIS REGULATION:

Article1

Regulation (EEC) No 386/90 is hereby amended as follows:

1. In Article 2:

the following shall be inserted: ,

‘(b) physical checks on substitution in accordance with Article 3a, and’

(b) shall become (c).

2. Article 3 (2) shall be replaced by the following:

‘2. In accordance with the detailed rules to be determined under the procedure referred to in Article 6, the rate mentioned in paragraph 1 (b) shall apply:

per customs office,

per calendar year, and

per product sector.

However, the rate of 5 % per product sector may be replaced by a rate of 5 % covering all sectors insofar as the Member State applies a selection system based on a risk analysis carried out in accordance with criteria to be laid down in accordance with the procedure laid down in Article 6. In this case, a minimum rate of 2 % shall be compulsory per product sector.’

3. The following Article shall be inserted:

Article 3a

In the case of export declarations accepted by an internal customs office, a minimum rate or minimum rates of physical checks on substitution may be carried out by means of representative sampling by each customs office of exit from the Community. The various minimum checking rate(s) shall be determined in the light of the type of risk, in accordance with the procedure laid down in Article 6.’

Article2

Ändrad genom förordning (EU) nr 1234/2007.

This Regulation shall enter into force, on the seventh day following its publication in the Official Journal of the European Communities.

It shall apply from the calendar year following that of its publication.
