Commission Regulation (EU) No 215/2010 of 5 March 2010 amending Annex I to Regulation (EC) No 798/2008 laying down a list of third countries, territories, zones or compartments from which poultry and poultry products may be imported into and transit through the Community and the veterinary certification requirements (Text with EEA relevance)

med beaktande av fördraget om Europeiska unionens funktionssätt,
med beaktande av rådets direktiv 2009/158/EG av den 30 november 2009 om djurhälsovillkor för handel inom gemenskapen med och för import från tredjeland av fjäderfä och kläckägg, särskilt artiklarna 23.1, 24.2 och 26.2,
med beaktande av rådets direktiv 2002/99/EG av den 16 december 2002 om fastställande av djurhälsoregler för produktion, bearbetning, distribution och införsel av produkter av animaliskt ursprung avsedda att användas som livsmedel, särskilt artikel 8.1 första stycket, artiklarna 9.2 b och 9.4, och
(1) Enligt kommissionens förordning (EG) nr 798/2008 av den 8 augusti 2008 om fastställande av en förteckning över tredjeländer, områden, zoner eller delområden från vilka fjäderfä och fjäderfäprodukter får importeras till och transiteras genom gemenskapen samt kraven för veterinärintyg får varor som omfattas av den förordningen endast importeras till eller transiteras genom unionen från de tredjeländer, områden, zoner eller delområden som förtecknas i tabellen i del 1 i bilaga I till den förordningen. I förordningen fastställs även kraven för utfärdande av veterinärintyg för sådana varor och förlagorna för de veterinärintyg som ska åtfölja dem fastställs i del 2 i den bilagan.
(2) Enligt artikel 24.1 b i direktiv 2009/158/EG får varor inte importeras till unionen från tredjeländer, områden, zoner eller delområden där utbrott av aviär influensa eller Newcastlesjuka har påvisats och för vilka det inte längre kan intygas att de är fria från en av dessa sjukdomar, såvida inte den behöriga myndigheten i tredjelandet eller området vidtar åtgärder för att bekämpa dem som är minst likvärdiga med åtgärderna i rådets direktiv 2005/94/EG av den 20 december 2005 om gemenskapsåtgärder för bekämpning av aviär influensa och om upphävande av direktiv 92/40/EEG och i rådets direktiv 92/66/EEG av den 14 juli 1992 om införande av gemenskapsåtgärder för bekämpning av Newcastlesjukan.
(3) Från en del av Brasilien samt från Chile, Förenta staterna, Israel, Kanada och Kroatien, enligt förteckningen i del 1 i bilaga I till förordning (EG) nr 798/2008, är det för närvarande tillåtet att importera levande fjäderfä och ratiter, kläckägg av fjäderfä och ratiter samt kött av fjäderfä och ratiter till unionen.
(4) Dessa sex tredjeländer tillämpar åtgärder för bekämpning av Newcastlesjuka som är likvärdiga med dem som medlemsstaterna tillämpar i enlighet med direktiv 92/66/EEG, vilka även inbegriper att det i områden på deras territorium kan införas officiella restriktioner på grund av utbrott av sjukdomen.
(5) För import av kött av fjäderfä och ratiter till unionen har denna likvärdighet redan erkänts för de åtgärder för bekämpning av Newcastlesjuka som tillämpas i delar av Brasilien och i Israel genom kommissionens beslut 2001/659/EG av den 6 augusti 2001 om ändring av beslut 94/984/EG när det gäller import av färskt fjäderfäkött från Brasilien och kommissionens beslut 97/593/EG av den 29 juli 1997 om fastställande av djurhälsovillkor och veterinärintyg vid import av färskt fjäderfäkött från Israel.
(6) Med beaktande av att åtgärderna för bekämpning av Newcastlesjuka är likvärdiga och att dessa tredjeländer har kapacitet att effektivt hantera utbrott av denna sjukdom samt resultaten och uppföljningen av inspektionerna i dessa länder bör särskilda intygskrav fastställas i fråga om frihet från denna sjukdom.
(7) För import av levande fjäderfä och kläckägg av fjäderfä och ratiter till unionen bör uppgiften i kolumn 6 (särskilda villkor) i del 1 i bilaga I och veterinärintygen i del 2 i bilaga I till förordning (EG) nr 798/2008 ändras, så att man vid framtida utbrott av Newcastlesjuka i Brasilien, Chile, Förenta staterna, Israel, Kanada och Kroatien, enligt förteckningen i del 1 i bilaga I till förordning (EG) nr 798/2008, kan fortsätta att importera dessa varor från de delar av dessa tredjeländer som inte omfattas av officiella restriktioner på grund av Newcastlesjuka.
(8) För import av kött av fjäderfä och ratiter till unionen bör uppgiften i kolumn 6 (särskilda villkor) i del 1 i bilaga I och veterinärintygen i del 2 i bilaga I till förordning (EG) nr 798/2008 ändras, så att man vid framtida utbrott av Newcastlesjuka i Chile, Förenta staterna, Kanada och Kroatien enligt förteckningen i del 1 i bilaga I till förordning (EG) nr 798/2008, kan fortsätta att importera dessa varor från de delar av dessa tredjeländer som inte omfattas av officiella restriktioner på grund av Newcastlesjuka.
(9) Dessutom bör veterinärintyget för import av kött av fjäderfä i del 2 i bilaga I till förordning (EG) nr 798/2008 ändras för att tillåta import av det kött som erhålls från slaktfjäderfän som härrör från ett annat av de tredjeländer som förtecknas i del 1 i bilaga I till den förordningen.
(10) Genom kommissionens förordning (EG) nr 411/2009 av den 18 maj 2009 om ändring av förordning (EG) nr 798/2008 om fastställande av en förteckning över tredjeländer, områden, zoner eller delområden från vilka fjäderfä och fjäderfäprodukter får importeras till och transiteras genom gemenskapen samt kraven för veterinärintyg har redan de sjukdomsbekämpningsåtgärder som Kanada tillämpar i fråga om lågpatogen aviär influensa erkänts som likvärdiga och intygskraven ändrats i enlighet med detta. För enhetlighetens skull bör därför dessa intygskrav anpassas till de intygskrav som införs genom den här förordningen.
(11) Bilaga I till förordning (EG) nr 798/2008 bör därför ändras i enlighet med detta.
(12) En övergångsperiod bör medges så att medlemsstaterna och industrin kan vidta nödvändiga åtgärder för att uppfylla de tillämpliga kraven för utfärdande av veterinärintyg i denna förordning.
(13) De åtgärder som föreskrivs i denna förordning är förenliga med yttrandet från ständiga kommittén för livsmedelskedjan och djurhälsa.
HÄRIGENOM FÖRESKRIVS FÖLJANDE.
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Directive 2009/158/EC of 30 November 2009 on animal health conditions governing intra-Community trade in, and imports from third countries of, poultry and hatching eggs, and in particular Articles 23(1), 24(2) and 26(2) thereof,
Having regard to Council Directive 2002/99/EC of 16 December 2002 laying down the animal health rules governing the production, processing, distribution and introduction of products of animal origin for human consumption, and in particular the first subparagraph of Article 8(1), Article 9(2)(b) and Article 9(4) thereof,
(1) Commission Regulation (EC) No 798/2008 of 8 August 2008 laying down a list of third countries, territories, zones or compartments from which poultry and poultry products may be imported into and transit through the Community and the veterinary certification requirements provides that the commodities covered by it are only to be imported into and transited through the Union from the third countries, territories, zones or compartments listed in the table in Part 1 of Annex I thereto. It also lays down the veterinary certification requirements for such commodities and models of the veterinary certificates to accompany them are set out in Part 2 of that Annex.
(2) According to Article 24(1)(b) of Directive 2009/158/EC, commodities are not to be imported into the Union from a third country, territory, zone or compartment where an outbreak of avian influenza or Newcastle disease has been detected and which may therefore no longer be certified as being free from one of those diseases, unless the competent authority of the third country or territory applies measures to control them which are at least equivalent to those laid down in Council Directive 2005/94/EC of 20 December 2005 on Community measures for the control of avian influenza and repealing Directive 92/40/EEC and in Council Directive 92/66/EEC of 14 July 1992 introducing Community measures for the control of Newcastle disease.
(3) Part of the territory of Brazil and the territories of Canada, Chile, Croatia, Israel and the United States of America, as listed in Part 1 of Annex I to Regulation (EC) No 798/2008, are currently authorised for the importation into the Union of live poultry and ratites, hatching eggs of poultry and ratites and meat of poultry and ratites.
(4) Those six third countries apply control measures for Newcastle disease equivalent to those implemented by Member States in accordance with Directive 92/66/EEC, including placing areas in their territory under official restrictions in the event of an outbreak of that disease.
(5) As regards the importation of meat of poultry and ratites into the Union, the equivalency of disease control measures for Newcastle disease applied in parts of Brazil and also in Israel has already been recognised by Commission Decision 2001/659/EC of 6 August 2001 amending Decision 94/984/EC as regards the importation of fresh poultry meat from Brazil and Commission Decision 97/593/EC of 29 July 1997 laying down animal health conditions and veterinary certificates for the importation of fresh poultry meat from Israel.
(6) Taking into account the equivalency of the control measures for Newcastle disease and the capacity of those third countries to effectively deal with an outbreak of that disease as well as the findings of and the follow-up actions to inspection missions to these countries, it is appropriate to provide for specific certification requirements as regards freedom from that disease.
(7) For the importation of live poultry and hatching eggs of poultry and ratites into the Union the entries in column 6 on the specific conditions in Part 1 of Annex I and the veterinary certificates set out in Part 2 of Annex I to Regulation (EC) No 798/2008 should be amended, so that in case of future outbreaks of Newcastle disease in Brazil, Canada, Chile, Croatia, Israel and the United States of America, as listed in Part 1 of Annex I to that Regulation, importation of those commodities may continue from the parts of those third countries that have not been placed under official restrictions due to Newcastle disease.
(8) For the importation of poultry meat and ratite meat into the Union the entries in column 6 on the specific conditions in Part 1 of Annex I and the veterinary certificates set out in Part 2 of Annex I to Regulation (EC) No 798/2008 should be amended, so that in case of future outbreaks of Newcastle disease in Canada, Chile, Croatia and the United States of America, as listed in Part 1 of Annex I to that Regulation, importation of those commodities may continue from the parts of those third countries that have not been placed under official restrictions due to Newcastle disease.
(9) Furthermore, the veterinary certificate for imports of poultry meat set out in Part 2 of Annex I to Regulation (EC) No 798/2008 should be amended in order to allow imports of that commodity obtained from slaughter poultry originating from another third country listed in Part 1 of Annex I to that Regulation.
(10) By Commission Regulation (EC) No 411/2009 of 18 May 2009 amending Regulation (EC) No 798/2008 laying down a list of third countries, territories, zones or compartments from which poultry and poultry products may be imported into and transit through the Community and the veterinary certification requirements disease control measures applied by Canada for low pathogenic avian influenza have already been recognised as equivalent and certification requirements were amended accordingly; it is therefore appropriate for reasons of consistency to align these certification requirements with those to be introduced by the present Regulation.
(11) Annex I to Regulation (EC) No 798/2008 should therefore be amended accordingly.
(12) It is appropriate to provide for a transitional period to permit Member States and industry to take the necessary measures to comply with the applicable veterinary certification requirements provided for in this Regulation.
(13) The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health,
HAS ADOPTED THIS REGULATION:
Article1¶
Annex I of Regulation (EC) No 798/2008 is amended in accordance with the Annex to this Regulation.
Article2¶
Commodities in respect of which the relevant veterinary certificates have been issued in accordance with Regulation (EC) No 798/2008 may continue to be imported into or transited through the Union until 1 June 2010.
Article3¶
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

II.2.4 has been: ( 6 )( 2 ) either [II.2.4.1 obtained from ratites from (an) establishment(s): (a) which receive(s)regular veterinary inspection visits to detect diseases transmissible to humansor animals; (b) which is (are) not subject to animal-health restrictions in connectionwith any disease to which ratites and/or other poultry are susceptible; (c) within a 10 km radius of which, including, where appropriate, the territoryof a neighbouring country, there has been no outbreak of highly pathogenicavian influenza or Newcastle disease for at least the previous 30 days;] ( 8 )( 2 ) or [II.2.4.1 boned and skinned and comes from ratites which were reared/ kept forat least three months prior to slaughter on establishments: (a) which receive regularveterinary inspection visits to detect diseases transmissible to humans oranimals; (b) which are not subject to animal-health restrictions in connection withany disease to which ratites and/or other poultry are susceptible; (c) on which there has been no outbreak of Newcastle disease or highlypathogenic avian influenza in the previous six months and around which nooutbreaks of highly pathogenic avian influenza or Newcastle disease have occurredfor at least three months within a distance of 10 km from the perimeter ofthat part of the establishment which contains the ratites, including whereappropriate the territory of a neighbouring country;] ( 2 ) or [II.2.4.1 boned and skinnedand comes from ratites from countries in Asia or Africa which: (a) were placed in isolation in tick-proofed surroundingsunder an officially approved programme for rodent control for at least 14days prior to slaughter; (b) before being movingto the tick-proofed surroundings, were: ( 2 ) either [examined to verifythat they were tick-free,] ( 2 ) or [underwent treatmentto ensure that all ticks on them were destroyed by (specify the treatment): , and this treatment has not givenrise to any detectable residues in the ratite meat;] (c) were checked forthe presence of ticks on arrival in the slaughterhouse (each batch), withnegative results;] II.2.5 has not been obtainedfrom ratites that were slaughtered under any animal health scheme for thecontrol or eradication of poultry and/or ratite diseases; II.2.6 comes from ratites: ( 2 )( 6 ) ( 9 ) either [II.2.6.1 that have been vaccinatedagainst Newcastle disease using a live vaccine in the 30 days preceding slaughter;] ( 2 )( 6 ) or [II.2.6.1 that have not been vaccinated against Newcastle disease using a livevaccine in the 30 days preceding slaughter;] ( 2 )( 8 ) either [II.2.6.1 that have not been vaccinated against Newcastle disease;] ( 2 )( 8 ) or [II.2.6.1 that have been vaccinated against Newcastle disease using a live vaccinewhich does not meet the requirements of Annex VI of Regulation (EC) No 798/2008but were not vaccinated in 30 days preceding slaughter;] ( 2 )( 8 ) or [II.2.6.1 that have been vaccinated against Newcastle disease using an inactivatedvaccine which meets the requirements of Annex VI of Regulation (EC) No 798/2008;] ( 8 )( 10 ) [II.2.7 comes from ratitesfrom establishments on which surveillance for Newcastle disease has been carriedout under a statistically based sampling plan which produced negative resultsfor at least the previous six months immediately prior to import to the Union;] II.2.8 comes from ratites that during transport to the slaughterhouse, didnot come into contact with poultry and/or ratites infected with highly pathogenicavian influenza or Newcastle disease;
II.2.9 comes from approved slaughterhouses which, at thetime of slaughter, were not under restrictions owing to a suspected or confirmedoutbreak of highly pathogenic avian influenza or Newcastle disease and withina 10 km radius of which there has been no outbreak of highly pathogenic avianinfluenza or Newcastle disease for at least the previous 30 days; and has not been in contact at any timeof slaughter, cutting, storage or transport with ratites or meat not complyingwith Regulation (EC) No 853/2004. II.3 Animal welfare attestation I, the undersigned official veterinarian,hereby certify that I have read and understood Directive 93/119/EC and thatthe meat described in this certificate comes from ratites that have been treatedin accordance with the relevant provisions of Directive 93/119/EC in the slaughterhousebefore and at the time of slaughter or killing. Notes Part I: — Box I.8: Provide the code for the zone or the compartment of origin,if necessary, as defined under code in column 2 of Part 1 of Annex I to Regulation(EC) No 798/2008. — Box I.11: Name,address and approval number of the establishment of dispatch. — Box I.15: Indicate the registration number(s) of railway wagons andlorries, the names of ships and, if known, the flight numbers of aircraft.In the case of transport in containers or boxes, the total number of theseand their registration and where there is a serial number of the seal it hasto be indicated in box I.23. Part II: (1) “Ratite meat” meansany parts, excluding offal, of farmed ratites that are fit for human consumptionand which have not undergone any treatment other than cold treatment to ensurepreservation; vacuum-wrapped meat or meat wrapped in a controlled atmospheremust also be accompanied by a certificate in accordance with this model. (2) Keep as appropriate. (3) Code of the territoryas it appears in column 2 of Part 1 of Annex I to Regulation (EC) No 798/2008. (4) Insert the name of compartment(s). (5) For countries or territories with the entry “N” in column 6 of Part1 of Annex I to Regulation (EC) No 798/2008, for meat of farmed ratites forhuman consumption (RAT) only, this means that in the case of an outbreak ofNewcastle disease as defined in Regulation (EC) No 798/2008 then the countrycode or territory code shall continue to be used but this will exclude anyarea under official restrictions, by the third country concerned in relationto Newcastle disease, at the date of issue of this certificate. (6) Not applicable to the countries with the entry “VII” in column 5 in Part 1 of Annex I toRegulation (EC) No 798/2008. (7) Indicate the dateor dates of slaughter. Imports of this meat shall not be allowed when obtainedfrom ratites slaughtered in the territory or the compartment(s) mentionedunder II.2.1 during a period where restrictive measures have been adoptedby the European Union against imports of this meat from this territory orthat (these) compartment(s). (8) Applicableonly to the countries with the entry “VII” incolumn 5 of Part 1 of Annex I to Regulation(EC) No 798/2008. (9) Such consignmentcan not be sent to Sweden or Finland. (10) In non-vaccinated flocks this surveillance is carried out by serologyand in vaccinated flocks it is carried out by tracheal swabs of ratites.
