EUROPEISKA KOMMISSIONEN HAR ANTAGIT DENNA FÖRORDNING

med beaktande av fördraget om Europeiska unionens funktionssätt,

med beaktande av Europaparlamentets och rådets förordning (EU) 2018/858 av den 30 maj 2018 om godkännande av och marknadskontroll över motorfordon och släpfordon till dessa fordon samt av system, komponenter och separata tekniska enheter som är avsedda för sådana fordon, om ändring av förordningarna (EG) nr 715/2007 och (EG) nr 595/2009 samt om upphävande av direktiv 2007/46/EG, särskilt artiklarna 24.4, 28.3 och 36.4, och

(1) I kommissionens genomförandeförordning (EU) 2020/683 fastställs ett standardiserat format för de dokument som används för typgodkännande av motorfordon och släpfordon till dessa fordon samt av system, komponenter och separata tekniska enheter som är avsedda för sådana fordon, i form av mallar för informationsdokument, godkännandeintyg, bilagan med provningsresultat och intyg om överensstämmelse på papper.

(2) Sedan den 1 januari 2021 används endast det globalt harmoniserade provningsförfarandet för lätta fordon (WLTP) för att fastställa om koldioxidutsläppsmålen uppfylls. Därför måste mallarna för informationsdokument, bilagan med provningsresultat och intyget om överensstämmelse på papper ändras genom att hänvisningarna till den nya europeiska körcykeln stryks.

(3) Med ikraftträdandet av kommissionens förordning (EU) 2017/2400 lade man till nya poster för koldioxidutsläpp och bränsleförbrukning för tunga fordon, såsom tunga bussar och medelstora lastbilar samt enskilt godkända tunga fordon, i intygen om överensstämmelse för tunga lastbilar. Därför måste de relevanta posterna läggas till i mallarna för intyg om överensstämmelse på papper för motsvarande fordonskategorier, samt i EU-intyg och nationella intyg om enskilt fordonsgodkännande.

(4) Med hänsyn till att de tunga fordonen är så olika i fråga om utformning, körmönster, årlig körsträcka, nyttolast och släpvagnskonfiguration har det genom Europaparlamentets och rådets förordningar (EU) 2017/2400 och (EU) 2019/1242 införts en klassificering av fordonsgrupper och undergrupper som återspeglar fordonens typiska användningsmönster och särskilda tekniska egenskaper. För att även ta hänsyn till nationella initiativ för att minska koldioxidutsläppen och för att det ska gå att tolka koldioxidutsläppen och bränsleförbrukningen på korrekt sätt är det nödvändigt att veta vilken fordonsgrupp eller undergrupp ett fordon tillhör. Därför måste relevant fordonsgrupp eller undergrupp läggas till i mallarna för intyg om överensstämmelse på papper och i EU-intyg om enskilt fordonsgodkännande.

(5) Med tanke på den ökande användningen av externt laddbara hybridelfordon i unionen är det viktigt att säkerställa att de nationella myndigheterna och konsumenterna får harmoniserad och enhetlig information om fordonens miljöprestanda. Det är därför lämpligt att klargöra att de värden som ska rapporteras i intyget om överensstämmelse när det gäller externt laddbara hybridelfordon är värdena avseende fasspecifika koldioxidutsläpp och bränsleförbrukning med hjälp av värdena för koldioxidmassutsläpp och bränsleförbrukning vid laddningsbevarande drift samt fasspecifik elenergiförbrukning för dessa fordon. Därför måste tillämpliga poster läggas till i mallarna för intyg om överensstämmelse.

(6) Efter offentliggörandet av genomförandeförordning (EU) 2020/683 har vissa fel konstaterats i anmärkningarna till informationsdokument, mallarna för godkännandeintyg och intygen om överensstämmelser på papper. De fel som konstaterats i anmärkningarna till informationsdokument och i mallarna för godkännandeintyg är felaktiga hänvisningar till vissa anmärkningar. Det finns också fel när det gäller den enhet som används för tryck i matningssystemet för släpfordons bromssystem, som bör vara kilopascal (kPa) och inte bar.

(7) När det gäller intyg om överensstämmelse på papper görs vissa förtydliganden för att ta hänsyn till provning av överensstämmelse i drift. Hänvisningarna till det provningsförfarande som gäller för färdigbyggda och etappvis färdigbyggda fordon av fordonskategori M3 och för icke färdigbyggda fordon av fordonskategori M2 måste också uppdateras, eftersom de för närvarande hänvisar till provningsförfarandet för lätta fordon i stället för till det provningsförfarande för tunga fordon som gäller för dessa fordonskategorier. Det måste förtydligas att posten angående fordonets höjd i intyget om överensstämmelse på papper endast gäller vissa färdigbyggda och etappvis färdigbyggda fordon av kategori N3. Det måste även preciseras att punkt 49 ”Koldioxidutsläpp/bränsleförbrukning/elenergiförbrukning” för fordonskategori N2 gäller lätta personbilar och lätta nyttofordon (Euro 5 och Euro 6) samt tunga fordon (Euro VI) och att punkt 49 för fordonskategori N3 inte gäller lätta personbilar och lätta nyttofordon (Euro 5 och Euro 6) utan endast tunga fordon (Euro VI). Ett fel i numreringen i posten ”drivaxel (drivaxlar), utrustad(e) med luftfjädring eller motsvarande” bör rättas så att den överensstämmer med numreringen i övriga delar av bilagorna till genomförandeförordning (EU) 2020/683. Anmärkningen till punkt 47.1.3.2 bör utgå eftersom en del av formeln felaktigt skrivits i upphöjd skrift i stället för i normal skrift. Av rättssäkerhetsskäl bör dessa fel rättas.

(8) Genomförandeförordning (EU) 2020/683 bör därför ändras och rättas i enlighet med detta.

(9) Enligt artikel 3.5 i kommissionens genomförandeförordning (EU) 2021/133 ska godkännandemyndigheterna, marknadskontrollmyndigheterna och registreringsmyndigheterna i medlemsstaterna samt tillverkarna inom 12 månader från dagen för offentliggörandet i Europeiska unionens officiella tidning av ändringarna av intyget om överensstämmelse papper genomföra eventuella nödvändiga ändringar i sina respektive system. Därför bör tillämpningsdatumet för ändringarna av intyget om överensstämmelse på papper senareläggas.

(10) För att ge godkännandemyndigheterna, marknadskontrollmyndigheterna och registreringsmyndigheterna i medlemsstaterna samt tillverkarna tillräckligt med tid för att genomföra de ändringar som fastställs i den här förordningen bör tillämpningsdatumet för bilaga II senareläggas.

(11) De åtgärder som föreskrivs i denna förordning är förenliga med yttrandet från tekniska kommittén för motorfordon.

HÄRIGENOM FÖRESKRIVS FÖLJANDE.

Article1¶Amendments to Implementing Regulation (EU) 2020/683

Annexes I, III, VI and VIII to Implementing Regulation (EU) 2020/683 are amended in accordance with Annex I to this Regulation.

Article2¶Corrections to Implementing Regulation (EU) 2020/683

Annexes I, III and VIII to Implementing Regulation (EU) 2020/683 are corrected in accordance with Annex II to this Regulation.

Article3¶Entry into force and application

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

Annex I shall apply from 1 January 2023.
