Laying down rules for the application of Regulation (EU) 2016/429 of the European Parliament and of the Council as regards the approval of the disease-free and non-vaccination status of certain Member States or zones or compartments thereof as regards certain listed diseases and the approval of eradication programmes for those listed diseases

(1) I förordning (EU) 2016/429 fastställs ett nytt regelverk för förebyggande och bekämpning av sjukdomar som kan överföras till djur eller människor. I synnerhet fastställs i förordning (EU) 2016/429 sjukdomsspecifika bestämmelser för de sjukdomar som förtecknas i enlighet med artikel 5.1, och i artikel 9 fastställs hur dessa bestämmelser ska tillämpas på olika kategorier av förtecknade sjukdomar. I förordning (EU) 2016/429 föreskrivs också att medlemsstaterna ska upprätta obligatoriska program för utrotning av de förtecknade sjukdomar som avses i artikel 9.1 b och valbara program för utrotning av de förtecknade sjukdomar som avses i artikel 9.1 c, och att sådana program ska godkännas av kommissionen. Dessutom föreskrivs att kommissionen ska godkänna sjukdomsfri status eller status som icke-vaccinerande för medlemsstater eller zoner eller anläggningskretsar däri med avseende på vissa förtecknade sjukdomar som avses i artikel 9.1 a, b och c i förordning (EU) 2016/429.
(2) I kommissionens genomförandeförordning (EU) 2018/1882 fastställs definitioner av sjukdomar i kategorierna A–E, och där anges att de bestämmelser om förebyggande och bekämpning av förtecknade sjukdomar som avses i artikel 9.1 i förordning (EU) 2016/429 ska tillämpas på de kategorier av förtecknade sjukdomar för förtecknade djurarter och grupper av förtecknade djurarter som avses i tabellen i bilagan till den förordningen. Den här förordningen bör innehålla bestämmelser vad gäller sjukdomar i kategorierna A, B och C.
(3) I förordning (EU) 2016/429 betraktas följande sjukdomar som förtecknade sjukdomar: infektion med Brucella abortus, B. melitensis och B. suis, infektion med Mycobacterium tuberculosis-komplexet, infektion med rabiesvirus, enzootisk bovin leukos, infektion med blåtungevirus (serotyperna 1–24), bovin virusdiarré, infektiös bovin rhinotrakeit/infektiös pustulär vulvovaginit, infektion med Aujeszkys sjukdom-virus, angrepp av Varroa spp., infektion med Newcastlesjukevirus, infektion med högpatogent aviärt influensavirus, viral hemorragisk septikemi, infektiös hematopoietisk nekros, infektion med ILA HPRΔ-virus, infektion med Marteilia refringens, infektion med Bonamia exitiosa, infektion med Bonamia ostreae och infektion med WSS-virus. Alla dessa förtecknade sjukdomar omfattas av de definitioner av sjukdomar i kategorierna A, B eller C som fastställs i genomförandeförordning (EU) 2018/1882 och förtecknas i tabellen i bilagan till den genomförandeförordningen.
(4) Kommissionens delegerade förordning (EU) 2020/689 kompletterar bestämmelserna i förordning (EU) 2016/429 om övervakning, utrotningsprogram och sjukdomsfri status vad gäller vissa förtecknade sjukdomar hos landlevande, vattenlevande och andra djur. I synnerhet fastställs i delegerad förordning (EU) 2020/689 kriterier för beviljande av sjukdomsfri status för medlemsstater eller zoner eller anläggningskretsar däri samt kraven för godkännande av utrotningsprogram för medlemsstater eller zoner eller anläggningskretsar däri.
(5) I artikel 85 i förordning (EU) 2020/689 anges att medlemsstater och zoner däri med ett utrotnings- eller övervakningsprogram för sjukdomar i kategori C som godkänts före tillämpningsdagen för den förordningen ska anses ha ett godkänt utrotningsprogram i enlighet med den förordningen under en period om sex år från tillämpningsdagen för den förordningen. Följaktligen bör denna begränsning anges i de tillämpliga bilagorna till den här förordningen.
(6) Genom bestämmelserna i artikel 280 i förordning (EU) 2016/429 fastställs regler för medlemsstater eller zoner eller anläggningskretsar däri som ska anses ha befintlig sjukdomsfri status eller godkänt utrotnings- eller övervakningsprogram vad gäller vissa förtecknade sjukdomar som har godkänts genom kommissionsakter antagna i enlighet med rådets direktiv 64/432/EEG, 91/68/EEG, 92/65/EEG, 2005/94/EG, 2006/88/EG eller 2009/158/EG. Dessutom kompletterar artiklarna 84 och 85 i delegerad förordning (EU) 2020/689 bestämmelserna i förordning (EU) 2016/429 i det avseendet genom att fastställa övergångsbestämmelser för befintlig sjukdomsfri status och befintliga godkända utrotnings- och övervakningsprogram vad gäller dessa förtecknade sjukdomar.
(7) För enkelhetens och öppenhetens skull bör förteckningarna över befintliga sjukdomsfria medlemsstater, zoner och anläggningskretsar och befintliga godkända utrotnings- och övervakningsprogram som anges i de kommissionsakter som antagits i enlighet med de direktiv som avses i artikel 280 i förordning (EU) 2016/429 och i vissa direktiv som avses i artiklarna 84 och 85 i delegerad förordning (EU) 2020/689 ersättas med förteckningar i bilagorna till den här förordningen.
(8) För vissa förtecknade sjukdomar fastställs bestämmelser om godkännande av sjukdomsfri status för medlemsstater eller zoner eller anläggningskretsar däri för första gången i delegerad förordning (EU) 2020/689, och därför är bestämmelserna i artikel 280 i förordning (EU) 2016/429 inte tillämpliga på dem. Så är fallet för infektion med rabiesvirus, infektion med blåtungevirus (serotyperna 1–24), bovin virusdiarré och infektion med Bonamia exitiosa. Flera medlemsstater har lämnat in ansökningar till kommissionen om beviljande av sjukdomsfri status vad gäller dessa förtecknade sjukdomar. Enligt kommissionens bedömning har dessa ansökningar visat sig uppfylla kriterierna i del II kapitel 4 avsnitten 1 och 2 i delegerad förordning (EU) 2020/689 där det fastställs bestämmelser om beviljande av sjukdomsfri status för medlemsstater eller zoner och anläggningskretsar däri. Därför bör sjukdomsfri status beviljas för dessa medlemsstater eller berörda zoner eller anläggningskretsar däri, och de bör förtecknas i bilagorna till den här förordningen.
(9) I delegerad förordning (EU) 2020/689 fastställs bestämmelser om godkännande av utrotningsprogram för medlemsstater eller zoner eller anläggningskretsar däri för vissa förtecknade sjukdomar som inte omfattas av bestämmelserna i artikel 280 i förordning (EU) 2016/429. Så är fallet för infektion med Brucella abortus, B. melitensis och B. suis, infektion med Mycobacterium tuberculosis-komplexet, infektion med rabiesvirus, enzootisk bovin leukos, infektion med blåtungevirus (serotyperna 1–24), bovin virusdiarré och infektion med Bonamia exitiosa. Flera medlemsstater har lämnat in ansökningar till kommissionen om godkännande av program för utrotning av dessa förtecknade sjukdomar. Enligt kommissionens bedömning har dessa ansökningar visat sig uppfylla kriterierna i del II kapitlen 2 och 3 i delegerad förordning (EU) 2020/689 där det fastställs kriterier för godkännande av program för utrotning av sjukdomar i kategorierna B och C hos landlevande respektive vattenlevande djur. Därför bör dessa utrotningsprogram godkännas och medlemsstaterna eller zonerna och anläggningskretsarna däri bör förtecknas i bilagorna till den här förordningen.
(10) För vissa förtecknade sjukdomar har kommissionen ännu inte mottagit ansökningar om beviljande av sjukdomsfri status från medlemsstaterna, eller har ännu inte slutfört bedömningen av mottagna ansökningar. Så snart ansökningarna har mottagits eller när bedömningen har slutförts kan de berörda medlemsstaterna, zonerna eller anläggningskretsarna förtecknas i bilagorna till denna förordning.
(11) En medlemsstat har nyligen lämnat in en ansökan till kommissionen om beviljande av sjukdomsfri status för en zon vad gäller infektion med Brucella abortus, B. melitensis och B. suis. Enligt kommissionens bedömning uppfyller ansökan kriterierna i artikel 71 i delegerad förordning (EU) 2020/689 där det fastställs bestämmelser om erkännande av sjukdomsfri status på grundval av utrotningsprogram. Därför bör sjukdomsfri status beviljas för denna zon, och den bör förtecknas i bilagorna till den här förordningen.
(12) Vad gäller aviär influensa fastställs i kommissionens förordning (EG) nr 616/2009, antagen i enlighet med direktiv 2005/94/EG, att medlemsstaterna ska godkänna anläggningskretsar (tidigare kallade delområden) för fjäderfä och andra fåglar i fångenskap. Förteckningen över de godkända anläggningskretsarna är allmänt tillgänglig, och på kommissionens webbplats finns länkar till medlemsstaternas webbsidor med mer information. Anläggningskretsar för fjäderfä och andra fåglar i fångenskap som godkänts med avseende på aviär influensa enligt förordning (EG) nr 616/2009 bör i enlighet med förordning (EU) 2016/429 behålla sin sjukdomsfria status och bör förtecknas i bilagorna till den här förordningen.
(13) I kommissionens beslut 2003/467/EG förtecknas medlemsstater och regioner däri med status som officiellt fria från tuberkulos, brucellos och enzootisk bovin leukos i enlighet med direktiv 64/432/EEG. Dessa medlemsstater och regioner däri bör förtecknas i bilagorna till denna förordning.
(14) I kommissionens beslut 93/52/EEG förtecknas medlemsstater och regioner däri med status som officiellt fria från brucellos (B. Melitensis) i enlighet med direktiv 91/68/EEG. Dessa medlemsstater och regioner däri bör förtecknas i bilagorna till denna förordning.
(15) I kommissionens genomförandebeslut 2013/503/EU förtecknas medlemsstater eller områden däri som erkänts som varroafria i enlighet med direktiv 92/65/EEG. Dessa medlemsstater eller territorier däri bör förtecknas i bilagorna till denna förordning.
(16) I kommissionens beslut 94/963/EG och 95/98/EG fastställs Finlands och Sveriges status som icke-vaccinerande vad gäller Newcastlesjuka i enlighet med direktiv 2009/158/EG. Dessa medlemsstater bör förtecknas i bilagorna till denna förordning.
(17) I kommissionens beslut 2004/558/EG förtecknas regioner i medlemsstater som har status som fria från infektiös bovin rhinotrakeit och regioner i medlemsstater som har godkända program för utrotning av infektiös bovin rhinotrakeit i enlighet med direktiv 64/432/EEG. Regioner med status som fria från infektiös bovin rhinotrakeit bör förtecknas i bilagorna till denna förordning, medan regioner med godkända program för utrotning av infektiös bovin rhinotrakeit bör behålla sina program under en begränsad tidsperiod i enlighet med förordning (EU) 2020/689 och bör förtecknas i bilagorna till den här förordningen.
(18) I kommissionens beslut 2008/185/EG förtecknas de medlemsstater eller regioner däri som har status som fria från Aujeszkys sjukdom och de regioner som har godkända program för utrotning av Aujeszkys sjukdom i enlighet med direktiv 64/432/EEG. De medlemsstater eller regioner däri som har status som fria från Aujeszkys sjukdom bör förtecknas i bilagorna till den här förordningen, medan regioner med godkända program för utrotning av Aujeszkys sjukdom bör behålla sina program under en begränsad tidsperiod i enlighet med förordning (EU) 2020/689 och bör förtecknas i bilagorna till den här förordningen.
(19) I kommissionens beslut 2009/177/EG förtecknas medlemsstater, vissa zoner och anläggningskretsar (tidigare kallat delområden) med sjukdomsfri status eller godkända övervaknings- eller utrotningsprogram vad gäller förtecknade sjukdomar hos vattenlevande djur i enlighet med direktiv 2006/88/EG. Den sjukdomsfria statusen för dessa medlemsstater, zoner och anläggningskretsar bör förtecknas i bilagorna till den här förordningen, medan de godkända programmen bör behållas under en begränsad tidsperiod i enlighet med artikel 85 i förordning (EU) 2020/689 och bör förtecknas i bilagorna till den här förordningen.
(20) Vad gäller förtecknade sjukdomar hos vattenlevande djur finns det vissa sjukdomsfria zoner och anläggningskretsar samt godkända övervakningsprogram som inte förtecknas i beslut 2009/177/EG, men förteckningar över dem är allmänt tillgänglig på medlemsstaternas webbplatser i enlighet med direktiv 2006/88/EG. Dessa zoner och anläggningskretsar bör behålla sin sjukdomsfria status, medan programmen bör behållas under en begränsad tidsperiod i enlighet med artikel 85 i förordning (EU) 2020/689. Uppdaterad information om de anläggningar som är belägna i dessa sjukdomsfria zoner och anläggningskretsar eller som omfattas av dessa program anges på den allmänt tillgängliga webbplats som upprättats och underhållits i enlighet med artikel 185.3 i förordning (EU) 2016/429 och artikel 21.2 i kommissionens delegerade förordning (EU) 2020/691.
(21) Eftersom förteckningarna i besluten 93/52/EEG, 94/963/EG, 95/98/EG, 2003/467/EG, 2004/558/EG, 2008/185/EG och 2009/177/EG, förordning (EG) nr 616/2009 och genomförandebeslut 2013/503/EU ersätts med förteckningarna i bilagorna till den här förordningen, bör dessa akter upphävas och ersättas med den här förordningen.
(22) I enlighet med avtalet om Förenade konungariket Storbritannien och Nordirlands utträde ur Europeiska unionen och Europeiska atomenergigemenskapen (utträdesavtalet), särskilt artikel 5.4 i protokollet om Irland/Nordirland jämförd med bilaga 2 till det protokollet, är förordning (EU) 2016/429 och de kommissionsakter som grundar sig på den förordningen tillämpliga i och på Förenade kungariket med avseende på Nordirland efter utgången av den övergångsperiod som fastställs i utträdesavtalet. Av detta skäl bör Förenade kungariket (Nordirland) förtecknas i bilagorna till den här förordningen när det är relevant för Nordirland.
(23) Eftersom förordning (EU) 2016/429 tillämpas från och med den 21 april 2021 bör även den här förordningen tillämpas från och med det datumet.
(24) De åtgärder som föreskrivs i denna förordning är förenliga med yttrandet från ständiga kommittén för växter, djur, livsmedel och foder.
HÄRIGENOM FÖRESKRIVS FÖLJANDE.
Article1¶Subject matter and scope
1. This Regulation lays down implementing rules for the listed diseases referred to in Article 9(1)(a), (b) and (c) of Regulation (EU) 2016/429 of animals, as regards the disease-free and non-vaccination status of certain Member States or zones or compartments thereof, and the approval of eradication programmes for those listed diseases.
2. The Annexes to this Regulation list both the Member States or zones or compartments thereof whose disease-free status or eradication programmes shall be deemed to be approved as provided for in Article 280 of Regulation (EU) 2016/429, and those whose disease-free status and eradication programmes shall be duly approved by this Regulation and also duly listed in the Annexes thereto.
3. This Regulation lists in the Annexes thereto:
a) the Member States or zones or compartments thereof with approved compulsory eradication programmes for Category B diseases and optional eradication programmes for Category C diseases.
b) the Member States or zones thereof with approved disease-free status and non-vaccination status;
c) the compartments of Member States with recognised disease-free status.
Article2¶Infection with Brucella abortus, B. melitensis and B. suis
Ändrad genom förordning (EU) 2022/214.
1. The Member States or zones thereof with disease-free status from infection with Brucella abortus, B. melitensis and B. suis in bovine animal populations shall be listed in Chapter 1 of Part I of Annex I.
2. The Member States or zones thereof with disease-free status from infection with Brucella abortus, B. melitensis and B. suis in ovine and caprine animal populations shall be listed in Chapter 2 of Part I of Annex I.
3. The Member States or zones thereof with an approved compulsory eradication programme for infection with Brucella abortus, B. melitensis and B. suis in bovine animal populations shall be listed in Chapter 1 of Part II of Annex I.
4. The Member States or zones thereof with an approved compulsory eradication programme for infection with Brucella abortus, B. melitensis and B. suis in ovine and caprine animal populations shall be listed in Chapter 2 of Part II of Annex I.
Article3¶Infection with Mycobacterium tuberculosis complex (M. bovis, M. caprae and M. tuberculosis) (MTBC)
1. The Member States or zones thereof with disease-free status from infection with Mycobacterium tuberculosis complex (Mycobacterium bovis, M.caprae and M. tuberculosis) (MTBC) shall be listed in Part I of Annex II.
2. The Member States or zones thereof with an approved compulsory eradication programme for infection with MTBC shall be listed in Part II of Annex II.
Article4¶Infection with rabies virus (RABV)
1. The Member States or zones thereof with disease-free status from infection with rabies virus (RABV) shall be listed in Part I of Annex III.
2. The Member States or zones thereof with an approved compulsory eradication programme for infection with RABV shall be listed in Part II of Annex III.
Article5¶Enzootic bovine leukosis (EBL)
1. The Member States or zones thereof with disease-free status from enzootic bovine leukosis (EBL) shall be listed in Part I of Annex IV.
2. The Member States or zones thereof with an approved optional eradication programme for EBL shall be listed in Part II of Annex IV.
Article6¶Infectious bovine rhinotracheitis/infectious pustular vulvovaginitis (IBR/IPV)
1. The Member States or zones thereof with disease-free status from infectious bovine rinotracheitis/infectious pustular vulvovaginitis (IBR/IPV) shall be listed in Part I of Annex V.
2. The Member States or zones thereof with an approved optional eradication programme for IBR/IPV shall be listed in Part II of Annex V.
Article7¶Infection with Aujeszky’s disease virus(ADV)
1. The Member States or zones thereof with disease-free status from infection with Aujeszky’s disease virus (ADV) shall be listed in Part I of Annex VI.
2. The Member States or zones thereof with an approved optional eradication programme for infection with ADV shall be listed in Part II of Annex VI.
Article8¶Bovine viral diarrhoea (BVD)
1. The Member States or zones thereof with disease-free status from Bovine viral diarroea (BVD) shall be listed in Part I of Annex VII.
2. The Member States or zones thereof with an approved optional eradication programme for infection with BVD shall be listed in Part II of Annex VII.
Article9¶Infection with bluetongue virus (serotypes 1-24) (infection with BTV)
Upphävd genom förordning (EU) 2026/1215.
1. The Member States or zones thereof with disease-free status from infection with bluetongue virus (serotypes 1-24) (infection with BTV) shall be listed in Part I of Annex VIII.
2. The Member States or zones thereof with an approved optional eradication programme for infection with BTV shall be listed in Part II of Annex VIII.
Article10¶Infestation with Varroa spp.
The Member States or zones thereof with disease-free status from infestation with Varroa spp. shall be listed in Annex IX.
Article11¶Infection with Newcastle disease virus
The Member States or zones thereof with disease-free status from infection with Newcastle disease virus without vaccination shall be listed in Annex X.
Article12¶Infection with highly pathogenic avian influenza (HPAI)
Compartments of the Member States free from HPAI shall be listed in Annex XI.
Article13¶Viral haemorrhagic septicaemia (VHS)
1. The following shall be listed in Part I of Annex XII:
a) Member States where their whole territory has disease-free status from viral haemorrhagic septicaemia (VHS);
b) zones or compartments of Member States where more than 75 % of the territory of the Member State has disease-free status from VHS; and
c) zones or compartments of Member States with disease-free status from VHS, where the water catchment area supplying those zones or compartments of the Member State is shared with another Member State or a third country.
2. The following shall be listed in Part II of Annex XII:
a) Member States where their whole territory has an approved eradication programme for VHS;
b) zones and compartments of Member States where more than 75 % of the territory of the Member State has an approved eradication programme for VHS; and
c) zones and compartments of Member States with an approved eradication programme for VHS, where the water catchment area supplying those zones or compartments of the Member State is shared with another Member State or a third country.
Article14¶Infectious haematopoietic necrosis (IHN)
1. The following shall be listed in Part I of Annex XIII:
a) Member States where their whole territory has disease-free status from infectious haematopoietic necrosis (IHN);
b) zones or compartments of Member States where more than 75 % of the territory of the Member State has disease-free status from IHN; and
c) zones or compartments of Member States with disease-free status from IHN, where the water catchment area supplying those zones or compartments of the Member State is shared with another Member State or a third country.
2. The following shall be listed in Part II of Annex XIII:
a) Member States where their whole territory has an approved eradication programme for IHN;
b) zones and compartments of Member States where more than 75 % of the territory of the Member State has an approved eradication programme for IHN; and
c) zones and compartments of Member States with an approved eradication programme for IHN, where the water catchment area supplying those zones or compartments of the Member State is shared with another Member State or a third country.
Article15¶Infection with highly polymorphic region deleted infectious salmon anaemia virus (HPR-deleted ISAV)
1. The following shall be listed in Part I of Annex XIV:
a) Member States where their whole territory has disease-free status from infection with highly polymorphic region deleted infectious salmon anaemia virus (HPR-deleted ISAV);
b) zones or compartments of Member States where more than 75 % of the territory of the Member State has disease-free status from infection with HPR-deleted ISAV; and
c) zones or compartments of Member States with disease-free status from infection with HPR-deleted ISAV, where the water catchment area supplying those zones or compartments of the Member State is shared with another Member State or a third country.
2. The following shall be listed in Part II of Annex XIV:
a) Member States where their whole territory has an approved eradication programme for infection with HPR-deleted ISAV;
b) zones and compartments of Member States where more than 75 % of the territory of the Member State has an approved eradication programme for infection with HPR-deleted ISAV; and
c) zones and compartments of Member States with an approved eradication programme for infection with HPR-deleted ISAV, where the water catchment area supplying those zones or compartments of the Member State is shared with another Member State or a third country.
Article16¶Infection with Marteilia refringens
1. The following shall be listed in Part I of Annex XV:
a) Member States where their whole territory has disease-free status from infection with Marteilia refringens;
b) zones or compartments of Member States where more than 75 % of the territory of the Member State has disease-free status from infection with Marteilia refringens; and
c) zones or compartments of Member States with disease-free status from infection with Marteilia refringens, where the water catchment area supplying those zones or compartments of the Member State is shared with another Member State or a third country.
2. The following shall be listed in Part II of Annex XV:
a) Member States where their whole territory has an approved eradication programme for infection with Marteilia refringens;
b) zones and compartments of Member States where more than 75 % of the territory of the Member State has an approved eradication programme for infection with Marteilia refringens; and
c) zones and compartments of Member States with an approved eradication programme for infection with Marteilia refringens, where the water catchment area supplying those zones or compartments of the Member State is shared with another Member State or a third country.
Article17¶Infection with Bonamia exitiosa
1. The following shall be listed in Part I of Annex XVI:
a) Member States where their whole territory has disease-free status from infection with Bonamia exitiosa;
b) zones or compartments of Member States where more than 75 % of the territory of the Member State has disease-free status from infection with Bonamia exitiosa; and
c) zones or compartments of Member States with disease-free status from infection with Bonamia exitiosa, where the water catchment area supplying those zones or compartments of the Member State is shared with another Member State or a third country.
2. The following shall be listed in Part II of Annex XVI:
a) Member States where their whole territory has an approved eradication programme for infection with Bonamia exitiosa;
b) zones and compartments of Member States where more than 75 % of the territory of the Member State has an approved eradication programme for infection with Bonamia exitiosa; and

Article18¶Infection with Bonamia ostreae
1. The following shall be listed in Part I of Annex XVII:
a) Member States where their whole territory has disease-free status from infection with Bonamia ostreae;
b) zones or compartments of Member States where more than 75 % of the territory of the Member State has disease-free status from infection with Bonamia ostreae; and
c) zones or compartments of Member States with disease-free status from infection with Bonamia ostreae, where the water catchment area supplying those zones or compartments of the Member State is shared with another Member State or a third country.
2. The following shall be listed in Part II of Annex XVII:
