REGULATION (EEC) No 2518/74 OF THE COMMISSION of 4 October 1974 on the measures to be taken following the all-round increase with effect from 7 October 1974 of agricultural prices

THE COMMISSION OF THE EUROPEAN with the increased prices ; whereas, however, only COMMUNITIES, those refunds fixed in advance before the date on which the increase in prices became known should be so adjusted; Having regard to the Treaty establishing the European Economic Community; Whereas the measures provided for in this Regulation are in accordance with the Opinions of the relevant Having regard to Council Regulation (EEC) No Management Committees, 2496/74 (*) of 2 October 1974 varying the prices applicable in agriculture for the 1974/75 marketing year, and in particular Article 4 thereof; HAS ADOPTED THIS REGULATION : Whereas Regulation (EEC) No 2496/74 provides for an all-round increase in agricultural prices to take effect on 7 October 1974 ; whereas in certain cases Article 1 that Regulation lays down only a general rule which requires further clarification ; whereas in other cases 1 . i1) For the purpose of distinguishing between products falling within heading Nos 11.01 and 11.02 and those falling within subheading 23.02 A , products falling within heading Nos 11.01 and 11.02 shall be those meeting the following specifications : — a starch content (determined by the modified Ewers polarimetric method), referred to dry matter, exceeding 45 % by weight, — an ash content, by weight, referred to dry matter ( after deduction of any added minerals) not exceeding 1-6 % for rice , 2-5 % for wheat and rye , 3 % for barley, 4 % for buckwheat, 5 % for oats and 2 % for other cereals . F. AMYLACEOUS CEREAL PRODUCTS

Amendments to be made to Council Regulation (EEC) No 1132/74 (x): — Articles 1 , 5 and 7 : the amount of 8-20 units of account is replaced by 8-745 units of account ; — Articles 1 , 4 and 7: the amount of 10-20 units of account is replaced by 10-907 units of account ; — Article 3 : the amount of 10-45 units of account is replaced by 11-309 units of account.

Amendments to be made to Commission Regulation (EEC) No 1981/74 (2): — the amount of 8-20 units of account in the first indent of Article 1 is replaced by 8-745 units of account; — the amount of 10-20 units of account in the second indent of Article 1 is replaced by 10-907 units of account.

Add the following to the second subparagraph of Article 4 (2) :

'No adjustment shall be made to take into account the change in price levels fixed for 7 October 1974 .'

Amendments to be made to Commission Regulation (EEC) No 2012/74 (3): Add the following to Article 2 (3 ) (a): 'No adjustment being made for the part of the alteration of the threshold price resulting from the decision to increase prices on 7 October 1974 .'

Amendments to be made to Commission Regulation (EEC) No 1935/74:

The threshold prices are increased by: — 1-130 u.a./100 kg for long-grain husked rice; — 1-458 u.a./100 kg for round-grain wholly milled rice; — 1-638 u.a./100 kg for long-grain wholly milled rice.

Amendments to be made to Commission Regulation (EEC) No 1956/74 :

Add the following paragraphs to Article 2:

'3 . Before 1 September 1974 in respect of a transaction to be effected on or after 7 October 1974, the adjustment on the basis of the threshold price for paddy and semi-milled rice shall be made as follows : (a) in accordance with paragraphs 1 and 2 ; (b) by increasing the amount obtained : — in the case of paddy rice, by 0-904 u.a./100 kg; — in the case of round-grain semi-milled rice, by 1-369 u.a./100 kg; — in the case of long-grain semi-milled rice, by 1-528 u.a./100 kg.

4. In September 1974 in respect of a transaction to be effected on or after 7 October 1974, the adjustment on the basis of the threshold price shall be made, in respect of paddy and semi-milled rice, by adding to the amount of the levy or refund as fixed in advance the amount referred to in paragraph 3 (b) and, where appropriate, the amount referred to in paragraph 1 (c) of this Article.'

( a) in boxes ( including containers with individual compartments for each portion ); — at least three but not more than 12 individual portions, of an aggregate net weight not exceeding 250 g; or — a single portion of a net weight not exceeding 56 g.

(b ) in circular or polygonal boxes (other than square or rectangular) containing at least 12 individual portions of an aggregate net weight of not less than 450 g but not more than 1 000 g;

(c) in the form of slices wrapped separately in aluminium foil or of a plastic material the net weight of each slice not exceeding 30 g.

8) For the purposes of tariff subheading 23.07 B, ' milk products' means the products falling within tariff headings 04.01 , 04.02, 04.03 , 04.04 and subheadings 17.02 A and 17.05 A.

9) The compensatory amount per 100 kg net weight of product falling within this subheading is equal to the amount shown multiplied by the weight of milk fats contained in 100 kg of finished- product.

10) The compensatory amount per 100 kg net weight of product falling within this subheading is equal, for each percentage point of the sucrose content of 100 kg net weight of product, to the compensatory amount applicable ro 1 kg of white sugar.
